Several cases have occurred in which fees have been charged for service of summons in criminal cases, the Chief Constable directs that Superintendent's will bear in mind and draw the attention of Justice's Clerks to the above Scale of Fees. A sufficient number of copies of this Standing General Order have been sent to enable Superintendents to forward one to each Section, and the same will be placed in the General Order Books at Divisional Head Quarters and the Standing General Order Books in charge of Sectional Officers, thus avoiding copying. A copy of this Return will be forwarded to this Office, one kept at Divisional Head Quarters and one sent to the Contractors. Messrs. Briggs, Jones & Gibson (1924 Ltd. In the absence of the Chief Constable or the Deputy Chief Constable, Superintendents, will be held responsible that all misfits are pointed out to the Contractors representatives, that he garments requiring alteration are properly marked with chalk and the necessary particulars are fully entered in the Returns before mentioned. The garments requiring alteration will be taken by the Contractor's representatives on the day of the parade. After the garments requiring alteration have been received back form the Contractors, Superintendents will again, at once fit the same and report if the garments fit, if they do not, they will again be returned to the Contractors and a Report made to the Chief Constable when they have been satisfactorily altered. Helmets will be fitted on and a Return sent to this Office of those which do not fit, Stating thereon the size required, which information will also be forwarded to the Contractors:- Messrs. February 1929 Chester Winter Assizes The next Assizes for the County of Chester for the trial of prisoners at 11.am, on Thursday 7th February 1929, at Chester Castle. General Order No 27 2nd February 1929 Illumination of Motor Cars The Chief Constable forwards herewith for the information of Superintendents a copy of a written Judgement delivered by the Yorkshire West Riding Justices sitting at Otley, on 25th January 1929 and he directs that the same will be communicated to the Justice's Clerk of each Petty Sessional Divisions. The Justices at the request of the West Riding Solicitor have given very careful consideration to the Law relating to the illuminations of rear number plates on motor vehicles. It has been noticed that in various parts of the country, decisions are being given to the effect that the regulation requiring the rear number plates on Motor Vehicles to be illuminated has been repealed by the Road Transport Lighting Act of 1927. We do not agree with these decisions and I propose to give our reasons:- Acts of Parliament with Regulations, Orders and Bye Laws made under the power therein, conferred have been time to time required vehicle to exhibit specific lights for the purpose of indicating their position or their direction in which they are travelling. All Acts of Parliament referring to these lights were repealed by the 1927 Act and new provisions were then made. The Motor Car Act of 1903 and the order made thereunder required each owner of a Motor Car to register it with the proper Authority, giving a full description thereof. This Authority allotted a number giving at the same time their index letter. This was termed the identification mark and a plate had to be at the front and back showing this mark when the car was on the road. It was realised that the Mark could not be recognised at dark, so a Regulation was made that during certain hours a lamp should be kept burning on the car, so contrived as to illuminate and render easily distinguishable every letter and figure on the Plate on the back. The Roads Act of 1920 repealing certain Provisions of the Motor Car Act of 1903, gave the Minister of Transport power to make Regulations prescribing the size, shape and character of the identification Marks and to be displayed and manner in which they were to be displayed and rendered easily distinguishable whether by night or by day. The Minister afterwards made Regulations practically repeating those previous made. These he varied in April 1928 as to the hours only. This regulation requiring drivers of Motor Vehicles to illuminate their rear identification Mark on their cars, in our opinion has not been repealed by the Road Traffic Lighting Act of 1927. Section eleven of this last mentioned Act we consider only refers to lights on vehicles, and not to the lamps which are to be kept burning to illuminate the rear identification Mark. We cannot find anything in the 1927 Act, which varies the requirement as to this illumination, and we therefore have decided to convict. General Order 34 The Dangerous Drugs Acts 1920-1925 And Regulations made thereunder (Standing Order 34 19th February 1928) Referring to S.G.O.'s 221/1921 and 219/1928. Containing the Dangerous Drugs (Benzoyl-Morphine) Regulations .dated 16th November 1928. 4. Home Office Circular Letter dated 9th February 1929, No 423410/62, with regard to the above. And he directs that the same will be carefully perused by Superintendents who will explain as are considered such parts considered necessary to the Divisions so that the provisions of the Regulations may be given effect to. It will be observed that the Dangerous Drugs (consolidation) Regulations 1925 (No.1.above ) repeal the Regulations contained in Statutory and Rules and Orders 1921, No. 865, (No 3 in the documents forwarded with S.G.O. 221/1921 and amending Regulations referred to in S.G.O's. 260/1922:/ 80/1923: 225/1924: 201/1926 and the Provisional Rules referred to in No 2 of the documents forwarded with S.G.O. 219/1923. In consequence of this a supply of copies of all of all the new Regulations of 1928 (No. 1. 2and 3above ) are forwarded for distribution to Sections and Sub Sections in the County, where they will be kept in neat brown paper covers for reference by members of the Force. The repealed Regulations will be destroyed. Very great care must be taken not to destroy copies of Statutory Rules and Order 1921, No 864.containing the Raw Opium Regulations now at Sectional Stations. (a) The following points in connection with the new Regulations (which it will be seen came into operation on 1st January 1929) are To consolidation into one code the provisions of all the existing Regulations made under Section 7 of the Act of 1929, except the Dangerous Drugs (Benzoyl-Morphine) Regulations 1928, which, as explained below, it is more convenient to keep separate. And: (b) To apply the provisions of the existing Regulations to certain drugs and preparations which have recently been brought within Part 111 of the Act of 1920, namely Apart from the extension of control to the above- mentioned drugs and preparations, the new Regulations introduce no amendment which concern the Police except that, in consequence of the decision in Kingsbury V. Director of Public Prosecutions (6.L J.K.B.209) the working of the proviso to Regulation 4 of the 1921 Regulations has been amended so as administered by direction of a doctor or dentist, much be so administered in the presence of a doctor or dentist. The Dangerous Drugs (Benzoyl -morphine ) Regulations 1928 These Regulations replace the Provisional Rule. Forwarded with S.G.O. 219/1929, without any alteration except the addition of a regulation as to the diversion of drugs consigned to places outside Great Britain. As it is not the intention to authorise any dealings in benzoyl- morphine (except) possibly for the purpose of scientific research) the Regulations are different and have therefore been kept separate from the Regulations applicable to the other drugs.as far as the Secretary of State is aware. Benzoyl-morphine has been manufactured only for the purpose of the illicit drug traffic and has not been introduced into this country. Benzoyl -morphine should not be confused with Benzyl-morphine, an opium derivative which does not give rise to addiction, and which is used in medicine under the propriety name of Peronine. The Coca Leaves and Indian Hemp Regulations. 1928. These Regulations (which) came into operation on 1st July 1929) apply the provisions of the Raw Opium Regulations, 1921 -1924, to coca leaves and resins obtained from Indian Hemp (Hashish) and all preparations of which such resins form the base. Extracts and tinctures of Indian Hemp, however, are accepted from the Regulations, the reason being that they are specifically included in Part 111 of the Act of 1920 by Section 3 of the Act and consequently come within the Dangerous Drugs (Consolidation) Regulations. Coca Leaves, which have hitherto been treated as substances containing 1/10th per cent or more of cocaine and as therefore coming within Part 111 of the Act of 1920, are now by Section 1 of the Act of 1925 brought under Part 1 of the Act of 1920. A sufficient number of copies of The Standing Order have been sent to enable Superintendents to forward one to each Section and Sub Section and the same will be placed, one sheet on a page, in the Standing General Order Books at Divisional Headquarters and those of Sections, thus avoiding copying. (C) Directory of Registration & Licensing Authorities in Great Britain & Ireland and he directs that the same will be carefully perused by Superintendents and kept with other documents relating to above at Divisional Head Quarters. Extra copies are also forwarded to enable one to be supplied to each Section where they will be neatly kept as directed in the S.G.O. named so as to be available for any member of the Section. The other copies forwarded herewith will be distributed by Superintendents to the best advantage among Sergeants and Constables particularly those stationed in rural districts. General Order No 36 20th February 1929 Appointment of Consul for Austria The Chief Constable intimates for the information of the Constabulary that His Highness Government has received notification of the appointment of Mr Max Mannaberg, as Honorary Consul General of Austrian London, with a jurisdiction that comprises all England and Wales with the exception of the following towns where Austrian Consuls have been appointed:- Birmingham, Bradford, Hull, Liverpool, Plymouth, Sheffield and Southampton. The Exequatur empowering Mr Mannaberg to act in the above capacity has been signed by the Counsellor of State on be on behalf of His Majesty the King. General Order No 37 20th February 1929 Seizure of Stray Dogs Instances have occurred in which dogs, which apparently were well bred or valuable have been seized by the Police and have been destroyed in due course without reference to Head Quarters. It is to be thoroughly understood that such animals should on their arrival at the Police Station be specially reported upon so that the Chief Constable can, if necessary order extra days of detention, so as to find the owner or failing that to find a purchaser. General Order No 38 22nd February 1929 Wild Birds Protection Act The Chief Constable has today forwarded to Divisions copies of the Order of the Secretary of State date 18th October 1924, which he directs will be distributed among persons concerned a copy kept posted on each suitable places where permission can be obtained. Police Officers in charge of Sections will take the opportunity when in plain clothes to interview School Masters and others so that children may be warned against the taking of birds nest and eggs. It will be observed that a clause has been added which protects all birds during the whole of the year throughout the urban District of Hoylake and West Kirby and the Chief Constable directs that the Superintendents of the Wirral Division will draw the special attention to this additional clause. The Chief Constable has on several occasions had it brought to his notice that the provisions of the Law and the County Bye Laws are not enforced as they should be Constables. This is said to apply particularly to the taking of Plover's eggs and the destruction of waterfowl and their eggs. General Order No 55 18th March 1929 Road Fund Licenses Referring to General 200 / 27 with reference to the abuse of the 14 days of grace allowed to motorists in which to renew the licenses to motorists in which to renew their vehicle licenses, the Ministry of Transport intimates that in some areas it has been found that merely to note the identification numbers of motor cars is ineffective and that it is necessary actually to stop a car, in order to get evidence means of as to the as to the identity of the drivers. If vehicles are actually stopped it is desirable that some means should be devised whereby a vehicle should only be stopped once for the purpose of an enquiry into the use of an expired license during the "days of grace" for the purpose a gummed label has been printed, a supply of which has been forwarded herewith. The Chief Constable directs that Constables on ordinary points "patrol duty" will, when their duties permit, when their duty permit, if they observe a motor car vehicle being used with an expired Road Fund License stop same and the Constable will fill in on the label, in indelible pencil the Index, Mark and Number, and with the concurrence of the motorist affix the label to the windscreen, or in the case of a vehicle without a windscreen upon some other suitable portion of the vehicle such as the dashboard. If the motorist objects to the label, it should be explained to him that in that case he may suffer the inconvenience of being stopped on other occasions, during the "days of grace". The label cannot be affixed in opposition to the driver's wishes. It will be understood that whether a label is affixed to a car or not the particulars will be noted and reported and reported to this office in the usual way as directed in General Order 205/ 27. The Superintendent of the Constabulary Division will make arrangements for these members of the Force detailed for "Police Special Duty" (other than that the 13 referred to on the first sheet) to obtain two good meals, at such times as the men can be spared from duty, for the payment of which they will themselves be responsible, and will consequently be granted refreshment allowance for two meals in accordance with Regulation 71. Consequent upon the large detail of Constabulary required to protect property, maintain order, regulate traffic etc. it will be impossible to allow members of the Force to take their "Rest" days on 5th April 1929 and Superintendents will therefore rearrange the "Rest Days" for work commencing 31st March 1929 so that each man obtains his "Rest Day" during that week or the next two weeks. All ranks will be available for duty on 3rd April 1929. The extra hours duty which must necessarily be performed on this day by the Inspectors, Sergeants and Constables on "Special Service " and "Police Special" Duty respectively will be allowed at "Time Off" day duty two hours or so at a time on the most convenient days to be arranged by Superintendents between 4th April and 4th May 1929. Any member of the Force who has not been granted the weekly "Rest Day" or the "Extra hours" as "Time off" by the 4th May 1929 will report the fact through Superintendents to the Chief Constable and in submitting such reports (if any ) Superintendents, will explain the reason for non-compliance with these instructions. Attention is drawn to general instructions contained in General order 96/1909. The Chief Constable directs that the above will be taken into use on the 1st April 1929, from which date they will be the official lamp of the Cheshire Constabulary. Each Constable will be responsible for keeping the lamp in good order and also for the upkeep of same, for which an allowance of 6s/- per annum will be made. General Order No 77 24th April 1929 Firearms An extract from General Order No.69 of the 17h March 1929, is re-published for information. Great care must be exercised in "making the selection of the men to whom "the pistols are to be handed and the "Superintendents must satisfy themselves that such "men are cool-headed and fully capable of "loading and "unloading, using and cleaning the "pistols. The men should be clearly warned "that these arms are to be unloaded and "put away in safety as soon as the "Constable goes off duty, and that special "care is to be taken to ensure that "when the pistol is unloaded a cartridge "is not left in the barrel. Carelessness "this respect has been the cause "of frequent accidents. "The muzzle of the pistol, when "held in the hand is to be pointed upwards" or downwards, and in such a manner that "the discharge cannot endanger any "person if it should take place accidently". The Chief Constable wishes it to be understood that this Order, which was issued particularly with regard to automatic pistols, is applicable to all firearms in Police charge. No firearm is on any account to be stored or put away, when loaded. The usual extra precautions will be observed in watching roads and railway stations from Saturday previous to the Races the following Saturday and during Race-week Constables will be drawn more on the main roads leading towards Chester, and will work according to a Special Scale to be made out by the Superintendents. Superintendents will not withdraw men stationed in the vicinity of Chester or on the main thoroughfares leading thereto for duty at the Races. Two Constables from Macclesfield Division and two from Stockport Division, (in ordinary dress) will parade at the Chief Constables Office at 2.30 pm on Saturday 4th May 1929 to be stationed at Mollington, Eccleston, Boughton, and Upton as in previous years, for "Police Special Duty" in the outskirts of the City. Superintendents of Broxton and Wirral Divisions will work out the necessary special scales for these four extra Constables. "Constables of beats in the vicinity of Chester & forward copy of each to this Office on 2nd May 1929, and will at the same time, report where lodgings have been secured for these four Constables. The announcement will be read to every member of the Force, Superintendents will report, so as to reach this Office on 9th May 1929, that such has been done, and the name of any member who desires to avail himself of the opportunity afforded. Leggings will not be worn, but produced in straps with Greatcoats and Capes in those Divisions which parade in tunics and serge suits with capes in those Divisions parading in Greatcoats and Tunics, placed three paces in front of each man. The new electric lamp will be placed in the usual position by each Constable who parades. The County Motor Cycle will also be produced on the parade ground but it will be placed in such a position by the Constable in charge that it does not interfere with the movements of the Division when drilling. General Order No 84 30th April 1929 Police Summoned as Witness in Private Cases Referring to General Order 103/28 it was resolved at a Meeting of the Standing Joint Committee held on 20th April 1929 that in future whenever a Constable is served with a subpoena in a civil case that the sum of 5/- would be charged at the time of the interview, that the balance due, according to rank should be payable at the time the Constable when the Constable attends the civil Court. The effect of this Resolution will be that in future whenever a Constable of whatever rank is served with a subpoena and a statement taken from him, the sum of 5/- will be paid by the person serving the subpoena, and after the Constable has attended the Court the balance according to the scale on Form F1, together with the Constables travelling expenses and subsistence allowance, will be paid by the person who served the subpoena in the first instance. When submitting Constable's reports as to a subpoena having been served Superintendents will report whether the 5/- ( which in the event of the Constable's attendance not being required will not be returned) has been received and credited and after the hearing of the case the Constable will report on the result, the Superintendent will state whether the balance together with travelling expenses and subsistence allowance has been received and credited at the same time submitting Form F.17, for the amount due to the Constable. General Order No 88 2nd May 1929 Typewriters and Copying Apparatus The Chief Constable has given orders for a typewriter and copying apparatus to be supplied to each Division. In issuing Remington Typewriters with Lion Duplicators to each Division the Chief Constable directs that these typewriters will, be considered, with all books and records for use in the Divisional Office only, and in the charge of Superintendent of the Division. The typewriter will not be removed from the General Office or Superintendents Office, or use by any person other than the authorised staff, except under special circumstances, on the direct order of the Superintendent. Initial (original) reports made by Constables to senior officers or by senior ranks to those above them are not to be typed - it is essential that the initial report should be in the handwriting of the person who makes it. There is no objection to a minute on a report being typed, provided that the signature on the initials is in ink and made by the person responsible for the minute. The copying apparatus will be used for all routing purposes and every economy will be exercised in the use of the wax sheets, only such Constables who are conversant with the use of a typewriter being allowed to cut a stencil. Application will be made to this office, for the necessary ink, copying paper, but the copying paper now in possession of Superintendents will be used before an application is made for a further supply. General Order No 89 3rd May 1929 The Dangerous Drugs Acts Referring to S.G.O. 221/1921 The Chief Constable forwards herewith, for the information of the Constabulary, an extract from a Home Office letter, dated 1st May 1929, No. 532048/8 intimating that the Secretary of State has withdrawn from Dr. James Scott Webster the authority granted under the above Acts, to be in possession of or supply certain drugs and preparations and therefore Dr Webster cannot give prescriptions containing such drugs. This matter will be borne in mind by those members of the Constabulary who are deputed to examine the Registers, kept by Chemists in the County Area and by all ranks in case the person referred to should take up residence in Cheshire. Superintendents will report so as to reach this Office on the morning of 22nd May 1929, the names of the Candidates nominated, particulars of any withdrawals and whether a contest will take place. The Chief Constable is of the opinion that the services of Special Constables at the Polling Station will not be required, but this not prevent Superintendents arranging to utilise the services of Special Constables to perform a few hours, voluntary duty should such be considered necessary on the day of the Poll, or Declaration thereof. General Order No 105 22nd May 1929 Police Stations When the occupant of a Police Station has occasion to leave his station he will arrange that any adult person who may be left in his private portion of his house shall know where a Constable is to be found so that an enquiry can be directed for such Constable. In the event of the occupant believing that he will be absent from his lock-up for over two hours, it will be arranged that a Constable visits the Station at five minute before the hour and half hour, and remain till five minutes after the hour and half hour, the telephone operator being informed of the arrangement. The Constable who performs such Station duty as above indicated will note in his duty Book :- Visited................... Police Station half hourly in accordance with SGO105/1929 It is not necessary for a Constable detailed for Station Duty to enter the private quarters of the occupant except under certain circumstances where the telephone is installed in a private room. In all cases in which the Constable on Duty has to enter any private room other than that in which the telephone is located a note will be made in his Duty Book. General Order No 119 7th June 1929 Chester Autumn Assizes 17th June 1929 That part of General Order directing Inspector Lythgoe, Wirral Division, to attend for duty at the above, is hereby cancelled and Inspector Henderson, Crewe Division, will parade at the Chief Constable's Office at 10.15am on Monday 17th June 1929 for duty at the Assizes at Chest Castle. General Order No 120 10th June 1929 Visit of H.R.H The Princess Mary to Cheshire 14th June 1929 H.R.H The Princess Mary (Countess Lacelles) will visit the County of Chester on 14th and 15th June 1929 arriving at Crewe Railway Station at 1pm on 14th June 1929. H.R.H will travel through the Middlewich Division into Altrincham Division, hence to Tabley House, Tabley. Later in the day she will proceed to Knutsford and later again to Dunham Massey Hall through Altrincham, she will stay the night at Dunham Massey Hall. On 15th June 1929, H.R.H. leaves Dunham Massey Hall about 11.45 am, travelling along the Main Manchester to Chester Road to Chester where she is due to arrive at 12. 40pm. The Royal Car will slow down at Lostock Gralam at Northwich. The Chief Constable directs that Superintendents will arrange for Constables to be on duty at Cross Roads and at other places (where it is considered necessary) along the line of route, also at such places where it has been arranged by the Superintendent that the car conveying H.R.H. should slow down in order that people congregated have the opportunity of seeing her. The Constable on duty at such places will show a green flag on the approach of the Chief Constable's car, which will precede the car, conveying H.R.H. The Chief Constable's car will be driven by a Constable in uniform and will immediately precede the car in which H.R.H is a passenger. The Royal Car will carry a small Union Jack flag on the bonnet. There will be 3 or 4 other cars, following the Royal Car which will contain members of H.R.H's party. When the Constable on duty is aware that the Royal Car is about to pass, he should request the drivers of all vehicular traffic to slow down and draw to their left, and pay special attention to any cattle which may be on the road at such time endeavour to ensure that these do not cause obstruction. Constables on duty on the route are to bear in mind that their first duty is to control the traffic and the crowds, but that in these duties permit they should stand to attention and salute H.R.H. as she passes.
