General Order No 2 2nd January 1928 Local Taxation Licenses Copies of the notices (2) as to the taking out of licenses for the year 1928 in respect of Ceremonial Bearings, Male Servants, and Motor Cars and vehicles drawn by Motor Cars, which will be forwarded by the Clerk of the Cheshire County Council direct to Superintendents, will be posted in every parish in the County, on all Church and Chapel, doors, Police Station Notice Boards, and at other places where permission, can be obtained, on which public and parochial notices are usually exhibited. The notices must be kept posted for the first six weeks of 1928. In the Boroughs policed by the Cheshire Constabulary, as well as in towns and Urban Districts. Superintendents will arrange with local Bill posters to post the notices at the places before mentioned at a reasonable rate, which should be arranged beforehand. In Rural Districts the posting will be done, by the Police stationed in such Districts, if any expense is incurred for providing paste, etc. a bill for same will be submitted as herein, directed. The accounts from Bill posters, together with a Return on the accompanying form, or a memo saying the no. of expenses will be forwarded from each Division to this Office on the 11th January 1928. The Local Taxation Committee will not issue notices of reminder to persons who have in the past taken out dog licenses, Superintendents will cause dog owners who make enquiries from the Police, to be so informed. Farmers and others who desire to claim exemption from license duty in respect of dogs used for tendering sheep and cattle should be advised to apply at the nearest Post Office for the necessary forms of Declaration. The Dangerous Drugs Act, 1920 Additional Authority to be in possession of drugs and &c. granted by the Secretary of State. Referring to the list of Authorities granted by the Secretary of State, forwarded with S.G.O. 221/1921, The Chief Constable forwards herewith a copy of Authority dated 30th December 1927, granted to owners of British steam fishing vessels to be in possession of cocaine eye drops in such quantities as are required for the purpose of supplying their fishing vessels with the medical stores required to be provided under The Merchant Shipping Acts. These requirements are contained in scales issued by The Board of Trade on 2nd August last under Section 200 of the Merchant Shipping Act 1894, which came into force on 1st January 1928. Under these scales every steam fishing vessel absent from the United Kingdom for four days or more is required to carry a First Aid Case containing, among other things, one half ounce (1/2 oz.). Bottle of eye drops. If in the course of periodical inspection of the Dangerous Drugs Registers kept by chemists in the County any large sales of cocaine Eye drops to the owners of fishing vessels are disclosed, particularly will be reported to this Office. The following note will be made in red ink in column "Remarks" in the 5th entry of the List of Authorisations referred to in the first para. Of this Order commencing " Skipper of every British fishing vessel" :- "For additional authority granted to owners of British "steam fishing vessel on 30th December 1927 see S.G.O. 7/1928." Kendrick Acting with vigilance and zeal at Marple on the 15th December 1927, resulting in the apprehension of a man for Fowl stealing at Marple and recovering part of the stolen property. General Order No 39 7th February 1928 Wild Birds Protection Act The Chief Constable has today forwarded to Division, copies of the order of the Secretary of State, dated 15th October 1924, which he directs will be distributed among persons concerned, and a copy kept posted, on each of the Police Notice Boards and at other Suitable places where permission can be obtained. It will be observed that a clause has been added which protects all birds during the whole of the year throughout the Urban District of Hoylake and West Kirby and the Chief Constable directs that the Superintendents of the Wirral Division will draw the Special attention of the members of that Division to this additional clause. The Chief Constable has on several occasions it brought to his notice that the provisions of the law and the County Bye-Laws are not enforced as they should be by Constables. This is said to apply particularly to the taking of Plover's eggs and the destruction of waterfowl and their eggs. Persons, carrying guns, or prowling about the foreshore and on marsh land should be watched. All persons who commit this class of offence of offence should be proceeded against. The Superintendent of the Eddisbury Division will arrangements for those members of the Force for "Police Special Duty" (other than the 13 referred to on first sheet) to obtain two good meals, at such time as the men can be spared, from duty, for the men can be spared, from duty, for the payment of which, they will themselves be responsible and will subsequently be granted refreshment allowance for two meals, in accordance with Regulation 7. Consequences upon the large detail of Constabulary required to protect property, maintain order, regulate traffic etc. it will be impossible to allow members of the Force to take their "Rest days" on 11th April 1928, and Superintendents will therefore rearrange the "Rest days" for week for week commencing 8th April 1928 so that each man obtains his "Rest day", during that week or the next two weeks. All ranks will be available for duty on 11th April 1928. The extra hours duty which must necessarily be performed on this day, by the Inspectors, Sergeants and Constables engaged on " Special Service " and " Police Special" duty respectively will be allowed as "time off" day duty, two hours or so at a time on the most convenient days to be arranged by 12th April 1928 and 11TH May 1928. Any member of the Force who has not been granted the Weekly " Rest Day" or the " Extra Hours" as "Time Off" by 11th May 1928 will report the facts through Superintendents to the Chief Constable, in submitting such reports ( if any) Superintendents will explain the reason for non-compliance with these instructions. General Order No 80 16th April 1928 Summer Time 1928 The day on which "Summer Time" will come into operation for the year 1928, will be Sunday 22nd April, at 2 am, and the Chief Constable directs that Superintends and other members of the Constabulary will arrange for their own watches and clocks at Police Stations and Magistrates Rooms throughout the County to be put forward one hour at midnight, 21st April 1928. General Order No 81 16th April 1928 Government Inspection 1928 The usual instructions laid down in the General Order 83/1882, will be observed. Books etc. will not be placed in front of the men on parade, but will be kept inside the Police Station, ready for inspection. The refills of Constables memo Books, containing entries from 1st April 1927, will be in possession of Constables ready for production if required. Attention is drawn to S.G. O. 164/1899 re folding of Great Coats and Capes. All stations will be ready for Inspection. The usual return of:- 1. Men employed in other than Police Duties. 2. Sickness (for year ended 31st December 1927). 3. Return of Constables reported for Misconduct in each Division since 1st April 1927, showing, date, Rank and Name, offence and decision. These three Returns will be prepared on white foolscap paper and forwarded to this Office on 20th April 1927. Parade States made out on the card (Form D. 24) sent herewith to be handed by the Superintendent to the Chief Constable immediately on his arrival. A neat slip of paper will be put in each book at the place where the entry is made, as to same having been last inspected and also in defaulters sheets, to mark the place where misconduct reports, during the past year are entered. Dress:- Tunics, medals, white cotton gloves, In all cases except when Constables parade in Greatcoats, Superintendents must be prepared to put on Capes. Superintendents and Inspectors will wear medal ribbons, not medals. The Government Inspector will see any member of the Constabulary serving in any of the above Divisions who may have representations to make to him, or may wish to see him at the Superintendent's Office at Altrincham, Dukinfield, Runcorn, Crewe, Broxton and Oakmere on 24th, 25th and 26th April 1928, (as above) and any member of the Constabulary serving in the other Divisions at Headquarters, Chester, at 3 pm, on 28th April 1928. The announcement will be read to every member of the Force, and Superintendents will report, so as to reach this Office on 20th April 1928 that such has been done and the name of any member who desires to avail himself of this opportunity afforded. Leggings will not be worn, but be produced in straps, with Greatcoats and Capes, in those Divisions which parade in tunics and serge suits or with Capes in those Divisions which parade in tunics and serge suits, or with capes in those Divisions in Greatcoats and Tunics and placed three paces in front of each man. The receipt of this Order will be acknowledged by Superintendents of Divisions concerned. General Order No 82 S.G.O. 17TH April 1928 Road Traffic Lighting Act 1927. The Chief Constable forwards herewith a copy of the above Act of Parliament which comes into operation on 22nd April 1928, for the information of Superintendents and he directs that the same will be carefully perused and explained by Superintendents to the members of their Divisions. 1. (1) (a). Vehicles must carry two large lamps showing to the front a light from a reasonable distance. (b). Also a lamp showing to the rear a red light visible from a reasonable distance. 1. (4) (a). "The hours of darkness" means - as respects the period of summer time , between one hour after sunset and one hour before sunrise: (b.) as respects the remainder of the year, the time between one hour after sunset and one hour before sunrise; 5. (1) (a)In the case of bicycles not having a sidecar attached thereto, whether propelled by mechanical power or not, and in the case of tricycles not propelled by mechanical power, and in the case of invalid carriages, only a single lamp showing a white light to the front instead of two such lamps need to be carried. (b)In the case of bicycles and tricycles not propelled by mechanical mechanical power ; it shall not be necessary to carry a lamp showing a red light to the rear if the bicycle or tricycle has attached thereto an unobscured and efficient red reflector; (c ).In the case of bicycles not having a sidecar attached thereto, whether propelled by mechanical power or not, and in the case of tricycles not propelled by mechanical power, no lamp need be carried if the bicycle or tricycle is being by a person on foot as near as possible to the near or left - hand edge of the carriageway. 6. Provides that vehicles drawn by horses or other animals - (i) shall not require a lamp showing a red light to the rear if the lamp showing a light to the front also shows a red light to the rear and no part of the vehicle or any load thereby (ii)Vehicles carrying agricultural produce of an inflammable nature in the course of internal operations of the farm are exempt from carrying lamps (iii )Agriculture implements used by persons engaged in agricultural produce or articles required by him for use in agricultural need only carry one lamp on the off or right hand side showing a white light to the front and if this lamp shows a red light and the vehicle or load does not extend more than six feet behind such lamp or an efficient red reflector is carried, a separate red light is not required. (1). A load of any vehicle over hanging laterally more than twelve inches from the centre of the nearest side lamp requires a lamp showing a white light visible from a reasonable distance in substitution for or in addition to such side lamp to be carried on the side or each side on which the load so overhangs and placed so that no part of such load shall project outwards more than twelve inches beyond a vertical line through the centre of such substituted or additional lamp. (2). A vehicle carrying a load projecting to the rear more than six feet behind any lamp showing a red light to the rear or the red reflector requires a lamp showing a red light to be carried in substitution for or in addition to such lamp so that no part of such load shall project to the rear more than six feet measured horizontally beyond Substituted, or additional lamp. 1. (1). A vehicle drawing one or more vehicles does not require- (a) A lamp showing a red light to the rear. (b) The vehicle or vehicles be drawn need not carry a lamp Showing a light to the front. (c ) A lamp showing a red light need not be carried on any Vehicle being drawn except the rearmost vehicle: but if the distance between any such vehicles exceeds five feet each vehicle is required to carry the same lamps as if it were not a drawing vehicle, or a vehicle being drawn, and the provisions of Section 7 (as above) will apply to these vehicles. Particular attention is also drawn to Section 15 of the Act giving Interpretation of certain expressions. With reference to the above Order, Superintendents will not apply for a summons but will content themselves with giving a caution for offences under the above Act up to 1st May 1928, unless the offence is connected with some other offence of a more serious nature. A sufficient number of copies of this Standing General Order have been sent to enable Superintendents to forward one to each section, and the same will be placed one sheet on a page in the General Order Books at Divisional Headquarters and the Standing General Order Book in charge of Sectional Officers, thus avoiding copying. Before parading at this office each morning, each man must have obtained a meal in Chester, such meal to be sufficient to support him until dismissed at the Chief Constable's office after the Races, when he must obtain another meal. The usual extra precautions will be observed in watching roads and railway Stations from Saturday and during Race week. Constables will be drawn more on the main roads leading towards Chester, and will work according to a Special Scale to be made out by Superintendents. Superintendents will not withdraw men stationed in the vicinity of Chester or on the main thoroughfares leading thereto, for duty at the Races. Two Constables from Macclesfield Division and two from Stockport Division (in ordinary dress\) will parade at the Chief Constable's office at 2.30 pm. On Saturday, 5th May 1928, to be stationed at Mollington, Eccleston, Broughton and Upton, as in previous years, for "Police Special Duty" in the outskirts of the City. Superintendents of Broxton and Wirral Divisions will make out the necessary special scales for these four extra Constables of beat in the vicinity of Chester and forward copy of each to this Office on 3rd May 1928, and will at the same time report where lodging have been secured for these four extra Constables. GENERAL ORDER No 91 24th April 1928 General Order. BYE-LAWS AS TO DEPOSITE OF LITTER &C. Referring to G.O. 42/1928, Following Bye - Laws made by the County Council on 9th February 1928, are now in operation throughout the district Policed by the Cheshire Constabulary, the Municipal Boroughs of Crewe and Dukinfield, are an exception. ADVERTISING BILLS. 1. No person shall for the purpose of advertising or throw about or deposit in any street or public place, any bill, placard or other paper. WASTE PAPER REFUSE &C 2. No person shall sweep (i) or otherwise remove from any shop or house into any street any waste paper, shavings, or other refuse, or being a costermonger, newsvendor, or any other street trader, thrown down and leave in any street any bill, placard or other paper waste paper, throw down and leave in the street any waste paper, which shall have been torn off or removed from any bill posting station. No person shall (except by permission of the owner or occupier, person or authority having control thereof or unless authority by law to do so) place, any bottles or glass or china articles (broken or whole) and empty tins, old buckets, or other discarded household articles, any nails or other sharp substances (not being road material) or any waste paper shavings or in such quantity as to cause danger, or annoyance to persons passing along or over such street or public place. Provided that this Bye-Law, shall not apply to any market place is for the time being lawfully held, or to any street or place in which any of the acts referred to in this Bye-law are prohibited by or under an Act of Parliament or other Statutory Provision. In these Bye-Laws" Street" includes any highway or public bridge, and any road, lane, footway, court, alley or passage open to the public whether a thoroughfare or any vacant or common land to which the public have right of access. 3. Any person offending against the provisions of any of the foregoing Bye-laws shall be liable on summary conviction to a penalty not exceeding forty shillings for each offence. 4. Bye- law number 14 (Placing or depositing broken glass, etc. on highways or any other public places) made by the County Council on the 3rd day of August 1911, is hereby repealed. It will be observed that Bye-law No 14. Relating to the deposit of glass, etc. on the highway, made by the County Council on 3rd August 1911, is repealed; therefore this Bye-Law will be neatly ruled through, in red ink, in the Book of Bye-laws in possession of each member of the Force. Of Part 1 of the Regulations made by the County Council on 1st August 1912, under the Advertisement Reg: Act 1907, which directs that the consent of the County Council of the Urban or Rural District must be obtained before a hoarding or similar structure for advertising purpose is erected is in no way altered or revoked by the Regulations made on 10th February 1927. Under the Advertising Reg; Act 1925 and that it is still necessary for consent to be obtained before a hoarding or similar structure for advertising purposes is erected in the Urban or Rural Districts named in the Bye-laws made on 1st August 1912. Superintendents will at once, get into communication with the Clerks to the Councils and arrange to work in conjunction with the Council Concerned with a view to prevent as far as possible the erection of new hoardings and advertisement boards. It is essential that the Clerks to Council should notify the Superintendents if an application to erect a Board is received by them that the Superintendent should notify to the Clerk if Hoardings or Board are being erected which do not confirm with the Bye-laws referred to. General Order No 103 12th May 1928 Police Summoned as Witnesses in Private Cases At a meeting of the Standing Joint Committee held on 21st April 1928 1928, it was resolved that in future, whenever a Constable is subpoenaed as a witness in a civil case to give evidence at Assizes Quarter Sessions County Court, etc. a charge, accordingly to rank, should be made for his services. The Chief Constable therefore directs that Superintendents will arrange, whenever a Constable receives a subpoena, that the firm of Solicitors serving the subpoena are requested to pay , in addition to the Constable's travelling expenses and subsistence allowance, a charge for the Constables services in lieu of conduct money according to the following scale:- Constables 15s /- per day Sergeants 20s. / - per day Inspectors 25s. / -per day Superintendents 30s. / - per day. Yearly 1928 (salmon body with broad scarlet mark down centre. 2nd Quarter of 1928 ( Pink ) General Order No 136 22nd June 1928 Billeting Rates Referring to General Order 134/1927, The Chief Constable has been informed that the rates payable for the billeting of Soldiers and horses laid down in Army Order 155 of 1926, copies of which were sent with General Order 114/1926incease , will remain in force until April 1929, except for the Increase from 2s/2d/- to 2s/5d of the maximum price for stable room with forage. All forms B.55 now will be amended as follows:- (a) The words "where direction have been given for embodying all, or any part of the Territorial Force" at the commencement of Section 108. A. (i) of the Army Act will be deleted. (b) The reference at the head of the Schedule at the end of the form will be to the Army and Air Force (annual) Act.1928 instead of to the Act of 1924. (c) The maximum price for stable room and forage as shown in the Schedule 2s.5d, instead of 1s.7d. A supply of Army Order 64 of 1928 is forwarded herewith a copy of same will be kept at each Divisional and Sectional Station in the County for reference, if required. General Order No 137 27th June 1928 The Road Vehicle ( Registration and Licensing ) ( Amendment Regulations 1928) Dated 12th June 1928 Referring to Special General Order 11/1925, 82/1928, and memo to Superintendents dated 15th June 1928, the Minister of Transport has now made Regulations, as above, providing that rear identification plates on motor vehicles (or front plates, on certain motor bicycles or tricycles) shall in future be illuminated during the same periods as the lamps required by Road Transport Lighting Act and not between half an hour after sunset and half an hour before sunrise all the year round, as before. The Regulations provide, as follows:- The Principal Regulations ( i.e. The Road Vehicles ( Registration and Licensing ) Regulations 1924, forwarded with Special General Order 11/1925 shall have effect as though Regulation 26 thereof were omitted and the following Regulation were inserted therefor that is to say;- 26. (1) Whenever during the day the hours of darkness as defined by sub. Section 4 of the Roads Transport Lighting Act. 1927 a vehicle is upon a public road, a lamp shall be kept burning on the vehicle, so contrived as to illuminate by means of reflection, transparency or otherwise, and render easily distinguishable every letter and figure of identification mark exhibited on the back of the vehicle or on the rearmost vehicle attached to the back of the vehicle, as the case maybe. (2 )In the application of this Regulation to a motor tricycle or a motor bicycle of a weigh unladed not exceeding three hundred weights, the plate fixed on the front of the vehicle may, if desired be substituted for the plate fixed on the back of the vehicle. The Regulations come into operation forthwith and Superintendents will read, and explain this Special General Order to all ranks at the Divisional and Sectional Parades during the month of July 1928 and certify in their Confidential Journals for that Month that such has been done. Paragraph 22.23. 26. Of the Road Vehicles (Regulation and Licensing) Regulations 1924 kept at Divisional and Stations will be neatly ruled through in red ink and the following note made in the margin opposite. General Order 161 21st July 1928 Police Athletic Association. The Chief Constable forwards herewith copy of Home Office letter No. 471, 706/21 dated 30th June 1926, with reference to the above. The Chief Constable regrets that he cannot accede to the suggestion contained therein - it is in his opinion impracticable to form in a County Force, teams representing the whole Constabulary branch of sport, for to do so would involve giving to a score or so of young members of the Force, special facilities to train, to practice, and to go away on leave to take part in competition, whilst other members perform question of liability for injuries incurred in Such Sports and Competitions, and for absence from duty consequent therefrom. This S.G.O. together with the copy of Home Office letter referred to will be brought to notice of each member of the Constabulary and Superintendents will report on 31st instant that such has been done. Sir, I am directed by the Secretary of State to refer to Item 2 and Appendix 1 of the minutes of the Central Conference of Chief Constables held on the 23rd November last, and to inform you that since that date the Committee whose proposals for the establishment of a Police Athletic Association were endorsed by the Conference has held a further meeting and presented a revised report defining more closely certain details of the scheme, and incorporating a number of amendments consequential upon the extension of the scheme to the Scottish Police forces. As no material alterations from the scheme as described in Appendix I of the Conference minutes have been made, the Secretary of State has not thought it necessary to circulate the revised report in full, but sufficient copies of the Provisional Rules of the Association together with a list of its officers are enclosed herewith to enable an issue to be made to the Superintendents. The Secretary of State is happy to say that H.R.H, The prince of Wales has graciously consented to be Patron of the Association. He has himself accepted, with much pleasure, the position of Joint President with the Secretary of State for Scotland, and he feels confident that he can rely upon Chief Officers of Police generally to give the scheme every encouragement within their powers. Application has been made to the Trustees of the National Police Fund for a grant of £1.000 to provide Championship trophies not to cost in any one case more than £30), and form the nucleus of a Guaranteed Fund to meet contingencies, and this application has been endorsed and is being recommended to the Trustees by the Advisory Council. The Secretary of State is informed that for the present year it is Proposed to organise one Championship meeting , to be held at Liverpool early in August and particulars will be made known to all Chief Constables by the Secretary of the Association, to whom any application for further information should be addressed. Arrangements for this meeting are now in hand. The Secretary of State commends this enterprise to all Chief Constables and to all members of the Forces concerned and hopes it will receive cordial support. He would ask, in particular, that the information conveyed in this circular may be made known, in such manner as you may think best, to Branch Boards, local Police Athletic Clubs, Sports Clubs, etc., and to Force generally, and that you will, so far as circumstances permit, encourage participation in the scheme and in the scheme and in any Championship meeting which may be arranged under the auspices of the Association. General Order No 169 31st July 1928 Appointment of Consul for Guatemala The Chief Constable intimated for the information of the Constabulary that His Majesty's Government has received notification of the appointment of Monsieur Leow Fleres, as Consul General for Guatemala at Liverpool with a jurisdiction that includes the County of Chester. Steps are being taken for the immediate issue to this Officer of the Kings Exequatur, and notification of its issue will be made in to the Constabulary in due course. (where the train will stop a few minutes ) travelling via Hartford, Acton Bridge and Warrington. The Chief Constable directs that special & precautions as to watching bridges, will be taken, the Constables at their posts at 9pm. on Wednesday 15th August 1928, and will remain until the Royal Train has passed. The Prince of Wales from London to Ballatar 23rd August 1928 On Thursday 23rd August 1928, His Royal Highness, The Prince of Wales will leave Rugby Railway Station at 9.35p.m. and will pass though Cheshire by the London Midland & Scottish Railway entering the County of Cheshire at the boundary between Cheshire and Staffordshire at the South side of Crewe Railway Station at about 10.56p.m, arriving at Crewe 11.3 p.m. and leaving again at 11.15p.m, travelling via Hartford, Acton Bridge and Warrington leaving the County area about 11.45p.m. The Chief Constable directs that special precautions as to watching bridges etc. will be taken and the Constables will be at their posts at 10.15p.m. Thursday 23rd August 1928, and will remain until the Royal Train has passed. O. 110/1927, the Chief Constable forwards herewith a, copy of Statutory Rules & Orders, 1928, No. 597, containing the above, which re-enact the Regulations made on 28th February 1927, forwarded with the S.G.O. referred, to and include as well as the Regulations made by the Secretary of State on 9th September 1927, in regard to the conveyance of Bisulphate of Carbon, in tank waggons, (with the enforcement of which Police are not likely to be, concerned). General Order No 200 15th September 1928 Duty Scales The Chief Constable directs that from 1st October 1928, duty scale "D" will be worked by all Divisions. In the event of Superintendents considering it necessary to alter the duty scale in consequence of any local occurrence they will do so, and report cause to the Chief Constable. General Order No 200 17th September 1928 THE HEAVY MOTOR CAR AMENDMENT ORDER 1928 The Chief Constable forwards herewith a copy of Statutory Rules and Orders 1928, No 614. Containing the above Order, dated 9th August 1928, made by the Minister of Transport, and he directs that the same will be carefully perused by Superintendents, who will explain the provisions of the same to all the members of their Divisions. The Order, which comes into force on 1st October, 1928, revokes Article V11 of the Heavy Motor Car Order 1904, and substitutes the following new Article:- Article V11 (1) The speed at which a heavy motor car which is not drawing a trailer may be driven on any highway shall not exceed- (a) If all the wheels of the heavy motor car are fitted with Pneumatic tyres, twenty miles per hour. (b) If some or all the wheels of the heavy motor car are not fitted with pneumatic tyres, but all the wheels not so fitted, fitted with tyres made of soft or elastic material, twelve miles per hour: (c) If some or all of the wheels of the heavy car are not fitted with either - pneumatic tyres made of soft elastic material, and the weight of the heavy motor car unladed does not exceed three tons: and the registered axle weight of no axle thereof exceeds six tons, eight miles per hour: (d) In any other case, five miles per hour, (2) The speed at which a heavy motor car drawing a trailer may be driven on any highway shall not exceed - (a) Where the trailer is so constructed and by partial superimposition attached to a heavy car that a substantial part of the weight of the (b) Heavy trailer is at all times borne by the heavy motor car, and all the wheels of the heavy motor car and the trailer are fitted with pneumatic tyres or tyres made of soft elastic material, twelve miles per hour : (c) Where the trailer is not so attached as aforesaid, (i) If all the wheels of the heavy motor car and of the trailer are fitted with pneumatic tyres, twelve miles per hour: (ii) If some or all of the wheels of the heavy motor car are not fitted with pneumatic tyres but all the wheels not so fitted with tyres made of soft or elastic material, eight miles per hour: (3) A tyre not for the purpose of the Regulations is deemed to be pneumatic unless:- (i) it is provided with a continuous closed chamber containing air at a pressure substantially exceed in atmospheric pressure when the tyre is in the condition in which it is normally used, but is not subjected to any load, (ii) it is capable of being inflated and deflated by the driver of the vehicle without removal from wheel or vehicle, and it is (iii) Such that when it is deflated and is subjected to a normal load the sides of the tyre collapse. Article V11 A. Except as hereinafter provided no person shall cause or person shall cause or permit a heavy motor car to be used on any highway, or shall drive or have charge of a heavy car when so used, unless a suitable reflecting mirror is so affixed to the heavy motor car as to enable the driver of such a heavy motor car to become aware of presence in rear thereof of any other vehicle, the driver of which is desirous of passing such heavy motor car. Provided that the requirements contained in this Regulation shall not apply if an when another person is carried or stationed at the rear of the heavy motor car, or in the case of a stage carriage carrying a conductor, where such conductor is normally stationed at the rear of the stage carriage, or, when any trailer is being drawn by the heavy motor car where another person is carried on the trailer in a position which affords an uninterrupted view to the rear end. And in each case, such conductor or other person is provided with efficient means of communicating to the driver of the heavy motor car the effects of signals given by drivers of other vehicles in rear thereof. It will be observed that the new Articles contain amended provisions as to the permissible speeds of heavy motor cars, and also require the provisions of reflecting mirrors on all heavy motor cars which do not carry a second person at the rear of the vehicle, or in the case of a vehicle drawing a trailer. A second person on the trailer with an uninterrupted view to the rear, who has efficient means of signalling the driver the effects of signals given by overtaking vehicles. The new speed limit laid down in Article V11 (i) for the various classes of heavy motor cars have been fixed after careful deliberation, with a view to the preservation of road surface as well as to consideration of public safety, and the Chief Constable directs that from the very commencement the Order will be rigorously enforced, the "timing cards" end Forms D.D.3 being sent to this Office before proceedings are commenced. The Chief Constable has no intention of allowing any further margin above the maximum speed level than is absolutely essential to adequately prove the case. With respect to the special problem presented by the long distance omnibuses and charabancs which run at regular schedules necessitating speeds in excess of 20 m.p.h. over at any rate portions of the route, the Secretary of State for the Home Department points out that in these cases the driver is the person primarily responsible in law for the speed of the vehicle, but it appears to him proper that proceedings should also be taken against the operators of the service for aiding and abetting the driver's offence if the circumstances appear to warrant such action. In this connection all ranks are to be warned as to the necessity for endeavouring to ascertain whether motor buses and such like are travelling upon a scheduled time table, and if so whenever possible a copy of the time table should be procured for the information of the Superintendent. An opportunity of obtaining this information and time table will probably occur when the driver of a heavy vehicle is being interrogated by the Constable and after being cautioned. Superintendents will, whenever possible, carry out the suggestion of the Secretary of State and, after the conviction of the driver, suggest to Head Quarters that proceedings be instituted against the operators of the service for aiding and abetting the driver's offence. The copy of the Order forwarded herewith will be retained at Superintendents Office, the necessary corrections to the existing Order being made in the Heavy Motor Car Order 1904 in pamphlets and books at Divisional and Sectional Stations. A sufficient number of copies of this Standing General Order have been sent to enable Superintendents to forward one to each Section, and the same, will be placed in the General Order Book in charge of Sectional Officers, thus avoiding copying. General Order No 203 21st September 1928 General Order The Dogs ( Amendment) Act 1926 (Standing General Order No203) ORDER THE DOGS ( AMENDMENT ) ACT 1926 The Chief Constable forwards herewith, for each Superintendent, a copy of the above Act, which received the Royal Assent on 3rd August 1928, and is now in force, and he directs that the same will be carefully perused and kept with other Acts relating to Dogs at Divisional Quarters. The Act, which amends the Dogs Act 1906, ( referred to in S.G.O. 503/1906) Contains important provisions and particular attention id drawn to the following:- Section 1. Provides that the owners of dogs shall be liable for injury to poultry by their dogs in the same manner as they are now liable for injury to cattle. Section 2. Revokes Section 4 of the 1906 Act and substitutes a new Section which provides that in all cases the finder of a stray dog shall forthwith either return it to the owner or take it to the nearest Police Station, the object being to enable the Police to obtain correct particulars of the dog and the place where it was lost. When a dog is taken to a Police Station, the finder has the option either of leaving the dog at the Station in which case the Police are required to deal with it as if it had been seized in pursuance of Section 3. Of the 1906 Act - or of keeping the dog he subject to the issue of a certificate by the Police. A supply of certificates ( Div. Form N. 36A) made up in book form has been sent to Divisions and The Chief Constable directs that a book of certificates will be kept at every Divisional and Sectional Station for use when required. It will be observed that the Certificates is to be made out in duplicate, one copy being given finder and the counterfoil retained by the Police. Whenever a Certificate under this Act is issued, a report of the occurrence on Form N.17 will be made and submitted to the Superintendent of the Division, and entered in the Divisional and Sectional Occurrence Books. If in any case where a stray dog is brought to a Police Station the Owner happens to be known to the Police, they should, of course take immediate steps to return it to the owner or to acquaint the owner of its detention, form N. 37. Being used for the latter purpose. As the finder of a dog elects to keep it is under obligation of keeping it for not less than one month, he should be informed when he is given a certificate that he must take out the dog license and steps should be taken to see that he does so. Section 3. Provides that Section 6. Of the 1906 Act (which provides that the owner of cattle shall not leave their carcases unburied in a place to which dogs can gain access) shall apply to a person having the control of cattle as it applies to the owner of cattle. In the case of a Constable finding a dog, he does so in his official capacity as a Constable and not as a private individual. If a Constable wishes to claim a stray animal, he can apply as heretofore, but the Chief Constable wishes to impress upon all Ranks, who will in their turn impress it upon the owners of dogs that an adult animal which has strayed once is liable to stray again, especially when it's new owner does not know the name it answer to and stray dogs in Agricultural County such as Cheshire area distinct menace to property. The Dangerous Drugs Act 1925, which by an Order in Council dated 14th August 1925, came into operation 25th September 1928, the date when the International Opium Convention with the provisions of which the Act was passed to comply, came into operation. 2. It will be observed from the Home Office letter that only proceeding for the illegal import and export of the drugs to which the Act of 1925 extends control can be instituted pending the issue of Regulations under Sections 3 and 7 of the Dangerous Drugs Act, 1920 and that such proceedings must be undertaken by the Officers of the Customs and Excise. The new Order extends control to coca leaves and Indian Hemp and the resin obtained from it (hashish) and also modified the definition of medicinal opinion for the purpose of the Dangerous Drugs Acts. The Home Office letter explains the application of provisions of the Dangerous Drugs Acts 1920, to the drugs Benzoyl, Morphine, Dihydro-oxycodeine, and Dihydrocodeine and their respective salts and to preparation, admixture and extracts containing them. General Order No 252 9th November 1928 Control of Traffic. The County Council has called the attention of the Chief Constable to the fact that some drivers of vehicles pull up upon cross roads just round (Upon) the bend converging roads, and even within the white lines at a bend, which the smallest exercise of intelligence should course them to avoid. The Chief Constable trusts that Superintendents will give clear orders to all ranks that these practices are to be watched for and reported, it may be that "Obstruction" could not be proved, but the Superintendent would, the Chief Constable is convinced, would take steps to caution and advise the Owners and Proprietors of the vehicles and thus stop a practice which is a menace to public safety. The stopping places for such vehicles as Motor Buses, should not be at a cross road, or where there is a turning. Owners and drivers should be made aware that in arranging for stopping in such places, the Chief Constables considers they take the risk of being, the cause of accidents. General Order No 258 16th November 1928 Shops ( hours of Closing ) Act, 1928 The Chief Constable has received intimation that an Order has been made by the Secretary of State suspending the operation throughout England and Wales of the provisions above Act relating to General closing hours from Monday 17th December 1928, to Monday 24th December 1928, both days inclusive:- This Order has the effect of suspending the operation, during the period in question, of Closing Orders made under the Act of 1912, but does not relieve occupiers and others from compliance with the weekly, half- holiday and other requirements of the Shops Acts of 1912 and 1913, or any requirements of the Licensing Act in regard to the sale of intoxicating liquor. General Order No 259 16th November 1928 Temporary Transfers No 280 Constable Frank William Statham, will on the 19th instant, be temporarily Transferred from Wirral Division to Stockport Division, to be stationed at Bramhall. Constable Statham will, continue to be paid by Wirral Division. General Order No260 19th November 1926 TRAFFIC SIGNALS Referring to S.G.O. 145/1925, the Chief Constable forwards herewith a supply of a revised "Traffic Signals" pamphlet, and he directs that a copy of the same will be handed to each Superintendent, Inspector, Sergeant, Acting - Sergeant and Constable in the Force. The revised pamphlet will take the place of the pamphlet forwarded with the S.G.O. above referred to, all copies of which will be collected and sent to Head Quarters on the 30th November 1928. It will be observed that the changes among the signals are few, though the general arrangement of the pamphlet and the note relating to the sign is somewhat altered Of the signals altered to be given by Constables, the "Stop" signal remains unaltered, but the "proceed" signals are now all to be given by a beckoning movement, the present signal (consisting of a horizontal sweep of the arm) having been withdrawn. The signals to be given to drivers of vehicles to other traffic have been reduced from five to three, and a new section has been added giving the signals to be used by drivers to indicate to Constables the direction in which they wish to proceed. The new signals will be at once adopted by all members of the Constabulary engaged in regulating traffic, and Superintendents and those in charge of Sections will see that the same are fully understood and given. The new pamphlet contains full instructions as to the various Police signals, which instructions have been introduced designedly in order to prevent , so far as possible , individual Constables on traffic duty introducing personal mannerisms into their method of giving the signals, or failing to give the signals with sufficient definiteness. Sectional Officers will be responsible, by actual demonstration, followed up by careful supervision and correction of any faults, for seeing that none but the correct signals are employed by Constables in their Sections. Many complaints have been made in the past as to the lack of uniformity in signals given by the Police in different parts of the country, and on a number of occasions proceedings against drivers of vehicles for neglecting to obey Police signals have failed on the ground that the signal was not understood by the driver, and the Chief Constable therefore emphasises the importance of removing any grounds of similar complaint in the future. Superintendents will report in their Confidential Journals for the months of November, December and January that this General Order has been fully explained at each Sectional Parade giving the dates and places at which such explanation was given. A sufficient number of copies of this Standing General Order has been sent to enable Superintendents to send one out to each Section, and the same will be placed, one sheet on a page in the General Order Books at Divisional Head Quarters and the Standing General Order Book in charge of Sectional Officers, thus avoiding copying. Notices re Dogs The returns issued by the National Canine Defence League will, when received, be posted on Police Notice Boards throughout the County as far as they will go. Motor Cycles and Motor Cars During the first week in January 1929. Licenses for Motor Cars and Motor Cycles will be obtained at Post Offices situated within the County Police Jurisdiction, and sent to this Office on 7th January 1929, for authority to charge the cost of same in Police Accounts. Sheep Worrying by Dogs Several cases of sheep worrying by dogs in different parts of the County having been reported, special attention is drawn to the Order of the Local Authority with reference to dogs being kept up during night time. The Chief Constable has drawn the attention of the Constabulary to the fact that when travelling through the County he has observed many breaches of the law, and since that time he has not seen much improvement and he again draws the attention of Superintendents to the matter. Attention will also be paid to the rear lights, carried on other vehicles, both motor and horse drawn, and proceedings will be taken where a red light, complying with the requirements, is not carried, or the number plate is not properly illuminated, or the light is not in accordance with the law in any other respect. The notices must be kept posted for the first six weeks in 1929. In the Borough policed by the Police Constabulary, as well as in towns and urban districts, Superintendent's will arrange with local Billposters to post the notices at the places before mentioned at a reasonable rate which should be arranged beforehand. In rural districts the posting will be done by the Police stationed in such districts and if any expense is incurred for providing paste etc. a bill for the same will be submitted as herein directed. The accounts from Billposters together with a return on the accompanying form, or a Memo, saying no expenses have been incurred, will be forwarded to this Office on the morning of 11th January 1929. The local Taxation Committee will not issue notices of reminder to persons who, in the past taken out dog licenses, and Superintendents will cause dog owners who make enquiries from the Police, to be so informed. Farmers and others who desire to claim exemption from license duty in respect of Dogs used for tending sheep and cattle should be informed to apply to the nearest Post Office for the necessary forms of declaration. A return on the following form will be sent to this Office on 11th January 1929. General Order No 274 20th December 1928 Road Fund Licenses Referring to General Order, 205/27 The Chief Constable has been informed by the Clerk to the County Council that a supply of forms on which to enter the motor vehicles, seen in use during the first 14 days of 1929, without a proper licence attached, has been forwarded to Superintendents and, he directs that these forms will be filled up and forwarded to this Office as directed in the above General Order. The colour of Licenses are as follows; Yearly 1929 Green and White. 1st Quarter of 1929 Pale Blue. General Order No 275 20th December 1928 Clothing and Helmets 1929 Immediately on receipt of the above Superintendents will forward to this Office the Contractors Invoices with number of Chevrons and Badges added thereto, and a report stating whether the articles mentioned therein have been received in good order or otherwise. The Clothing and Helmets must be kept in the Divisional store room, or in some other dry place, where they will not become injured or damaged. Clothing and Helmets received for Constables who have been transferred since the Force was measured will at once be sent to the Superintendents of the Division in which such men are now serving and those who have left the Force to Head Quarters.
