General Order No. 7 10th January 1921 County Property The Chief Constable directs that all County Property including window blinds at Police Stations whether in Public Rooms or in the occupiers private quarters will be entered of Form M/4. These Forms will be neatly posted on each card board and be hung up in a suitable place in each public room:- County property in private quarters will be entered on one form (the particular room in the article being shown in Column "Remarks" which will be hung up in Superintendents Offices at Divisional Quarters or in Sectional Offices. Superintendents will carefully check the property with the lists once each half year, ending 30th June 1921 and 31st December 1921. Any variation will be reported to Head Quarters. General Order No. 11 15th January 1921 Returns of Crime The Chief Constable directs that the Returns "J" forwarded herewith will be corrected so as to read for the 5th October 1920 instead of for the First Tuesday in April and returned to this Office on 20th Inst: In future this Return will be made out for the first Tuesday in October instead of the first Tuesday in April and sent to Head Quarters on 3rd November each year. General Order No. 14 20th January 1921 The Stolen and Found Motor Vehicles The Chief Constable has been informed that in connection with the new system of registration and licensing of motor vehicles which came into force on 1st January 1921 it has been decided with a view to checking the traffic in stolen cars to establish at New Scotland Yard a "Clearing House" for particulars of Motor vehicles reported to the Police as lost, stolen or found. The success of the scheme will of course depend on the cases being fully reported to the Clearing House. The following instructions are therefore issued for the information and guidance of Superintendents who will see that all members of the Divisions are fully instructed both as to the reporting of cases and the use of information which will be circulated in the Police Gazette. 1. Reporting of cases to the Clearing House When the police receive a report that a motor car or motor cycle has been lost, stolen or found, as the case may be in this County, particulars will be reported at once by the Superintendent of the Division, to the Clearing House for that purpose addressed to: The Commissionaire of Police Traffic Branch New Scotland Yard L.W.1 A supply of forms has this day been forwarded to each Superintendent, to be kept at Divisional Head Quarters but a specimen form will be supplied by the Superintendent to each Section and Sub-Section, and kept for ready reference, so that in the event of a report of a lost, stolen or found motor vehicle being received the necessary information to complete the form may be obtained from the informant, and furnished without delay to Superintendents 2. Reports issued by the Cleaning House will be published in the next issue of the "Police Gazette" and will also be circulated to Registration Authorities by the Cleaning House. In addition they will be issued, probably once a month to Chief Constable and Registration Authorities. A special supplement in the Police Gazette containing particulars of all cases reported to the Clearing House since the issue of the previous Supplement and not disposed in the meantime. The particulars will be circulated to Superintendents. 3. Use to be made of the Police Gazette Reports Full advantage will be taken of the Police Gazette reports in the following directions: (a) By keeping a look out for any of the missing vehicles (b) By warning dealers and garage proprietors in their districts (c ) By taking special precautions at Seaports to prevent any of the missing vehicles being taken out of the Country:. 4. Co-operation between the Police and the Registration Authorities The particulars of lost, stolen or found cars issued to Registration Authorities by the Cleaning House will assist those Authorities to detect attempts to secure a registration book, and license for a stolen Motor Car or Motor Cycle. Under Section 5 (2) of the Roads Act Registration Authorities are entitled on receipt of an applicant which purports to be the first application for a license for any vehicle to take steps to satisfy themselves that no license has in fact been issued and the Chief Constable has made arrangements with the Cheshire Registration Authority, so that any application which purports to be a first application for registration shall be reported to the Police for enquiries if there appears to be any reason to believe that the vehicle has been registered elsewhere. Superintendents will therefore act accordingly in the event of such a case being referred to them by the Local Registration Authority. General Order No. 15 20th January 1921 The Finance Act 1920 Propelled Road Vehicles position of License Card Holder That part of S.G.O. 378/1921 relating to the position of the License Card and " holder on all other kinds and types "Of mechanically propelled vehicles and types used on "roads" (set out at the foot of page 2 and top of page 3 of the S.G.O. named) is hereby cancelled, The Ministry of Transport having issued the following Regulation on this matter:- Position of Card and Holder B. In the case of all other Vehicles (except) when placed on or adjacent to the wind screen as hereafter to provided: On the near side of the vehicle facing towards the near side of the road and not less than two foot six inches nor more than six feet or six inches from the ground level between two parallel lines the first drawn vertically through rearmost part of the driving seat or Cab or where no such fitting exists the foot plate, and the second drawn vertically six inches in front of the base of the first glass wind screen, where fitted on where no such wind screen is fitted through a point four feet forward of the first line. Provided that in the case of a vehicle fitted with a front wind screen extending across the vehicle to the near side, the license may be carried facing either forwards or backwards on the near (left) lower corner of the near (left) lower corner of the glass of such wind screen or within two inches of the glass either from front or behind it, and so as to be visible through the glass either from in front or from behind. In the event of the license being carried actually upon a glass portion of the vehicle and otherwise complying with the Regulation, the obligation that it shall be carried in a metal holder with a clear glass front may be dispensed with if it is so carried as to weatherproof. The license Card must be placed and carried so as to be clearly visible at all times by daylight to a person standing at the near side of the vehicle, whether such vehicle is moving or stationery. It will be observed that the position of the card on Motor Cycles has not been interfered with and remains as in S.G.O. 371/1920. All ranks will carefully note the position in which the license cards may be fixed to motor vehicles as set forth above. Subsistence of Prisoners The amount to Lock- Up Keepers for subsistence of prisoners during detention in Police Cells from 7d- to 1s/- per meal, to be reconsidered at the Meeting of the Standing Joint Committee in October 1921. Stray Dogs The amount allowed for keep of stray dogs during detention by the Police from 4s/- to 6s/- per day to be reconsidered at the Meeting of the Standing Joint Committee in October 1921. General Order No. 21 24th January 1921 Licensed Houses Notice having been received that compensation under the Licensing Consolidation Act 1910 in respect of the licensed houses specified below will be paid on 19th February 1921 and that the licenses will expire on 19th February 1921 the Chief Constable directs that Superintendents will see that the licensed houses are closed accordingly and, report to him on 22nd February 1921 that such has been done. Parker General Order No. 23 28th January 1921 Geneva Convention Act 1911 Illegal Use of Red Cross Referring to General Orders 278/1914 and 132/1916 The Chief Constable has been informed that in several cases recently came to notice of the War Office of the un-authorised use by traders and others of the Red Cross and draws attention to the fact of the Emblem referred to the Red Cross for the purposes of trade or business or any other purpose whatsoever without the authority of the Army Council is an offence under Section 1 of the above Act. This Act was passed in consequence of the adhesion of His Majesty's Government to the Geneva Convention 1906 in which it sis stipulated that the Red Cross emblem or the words "Red Cross" shall not be used either in time or peace or in time of War except to protect and to or indicate the medical units and establishment and the personnel and material protected by the Convention i.e. The Army Medical Services, of the signatory powers and that the Signatory Governments shall prevent at all times the employment of the emblem or the words in question by private individuals or Societies (except those entitled to use it under the Convention) and especially to prevent their use for commercial purposes as a trade mark or trading mark. Members of the Constabulary will pay special attention to the matter and in the Instructions contained in the General Orders above referred 13. Any case of the un-authorised use of the emblem or words "Red Cross" should be reported to this Office. The arrangement regarding the issue of permits to the Owners of Vehicles who were allowed to use the Red Cross emblem on their vehicles being now obsolete: General Order 259/1917 is hereby cancelled. General Order No. 24 28th January 1921 Clothing and Caps 1921 Immediately on receipt of the above Superintendents, will forward to this Office the Contractor's invoices and a report stating whether the articles mentioned therein have been received in good order or otherwise; The Clothing and Caps must be kept in the Divisional Store room in or a dry place where they will not become injured or damaged. Clothing and Caps received for Constables who have been transferred since being measured will at once be sent to the Superintend of the Division such men are now serving, and those for Constables who have left the Force to Head Quarters. General Order No. 25 29th January 1921 Finance Act 1920 The Finance Act 1920 Licensing & Regulations of Mechanically Propelled Road Vehicles Referring to the last paragraph of S.G.O. dated 8th December 1920 directing Superintendents not to take proceedings against persons for non-compliance with the new Regulations during the month of January 1921 it has been brought to the notice of the Chief Constable that owing to the very large number of licenses to be prepared and to a great extent of work connected with the bringing into operation the new Regulations the Clerk to the County Council finds that it has been absolutely impossible to issue the licenses to applicants during the past month. Consequently the Chief Constable directs that the police will defer taking proceedings for at least another month except in flagrant and wilful cases. General Order No. 34 12th February 1921 Admission of Aliens Order into The United Kingdom In forwarding the accompanying copy of Home Office letter dated 10th February 1921 No. 386/155/58 regarding the admission of aliens into the united Kingdom for the information and guidance of Superintendents and retention at Divisional Head Quarters, the Chief Constable directs that under no circumstances whatever will any member of the Cheshire Constabulary endorse any document or give any certificate respecting the admission of any alien into the United Kingdom. The question of admission to aliens into this County is governed by the provisions of the Alien Order 1920 which are administered by the Immigration Officers under the direction of the Secretary of State and the granting of such certificates as those referred to are frequently misleading to the alien concerned, who may be refused to leave to land and render more difficult the work of the immigration Officers. Any persons who ask the Police for a letter, certificates or endorsement of any kind in order to secure admission of an alien into the United Kingdom should be informed that the Police are unable to assist him, an alien can obtain leave to land only from Immigration Officer at the part of his arrival in this Country and before starting on his journey he should apply for a visa to the nearest British Passport Control Office or British Consul. Further, if the alien desires to come to employment in this Country, a permit must first be obtained by the employer from the Ministry of Labour. General Order No. 38 17th February 1921 Rest Days With a view to ensuring uniformity in the hours "Rest Days" The Chief Constable directs that in the future Superintendents will so arrange that Inspectors, Sergeants and Constables who complete their tour of duty at or before 12 midnight will commence their "Rest Day" at 6a.m. the following morning, and those who complete their duty after 12 midnight and before 6a.m. will commence their "Rest Day", six hours after completing night duty, a Constable parading off duty at 2a.m. would commence at 8.a.m. Superintendents are authorised to so vary the hours of duty on the day, the "Rest Day" ends as to fit in with the hour the constable resumes duty. Should a special application be occasionally e made for a "Rest Day" to commence earlier than before mentioned, for any exceptional purpose, Superintendents may use their discretion as to allowing same, but it must be understood that "Rest Day" ends at the same hour twenty four hours later. General Order No. 42 18th February 1921 Payment of Rent of houses Occupied by the Police In accordance with the decision of the Standing Joint Committee, as the Police Authority the County is now responsible for the payments of the Rents of houses occupied by the Police, with the approval of the Chief Constable and such payment is made by repaying to the occupier, as Rent Allowance, the amount each man has paid as rent and where necessary as rates. This method of payment has rendered those concerned liable to assessment for Income Tax on the total amount received in any one year. With a view of avoiding the liability referred to in the next and in the future financial years (1st April 1921 to 31st April 1921) The Chief Constable is anxious for arrangements to be made, whereby the rent should be paid by Superintendents on behalf of the family, direct to the owners or agents, and the Rates where such are not included, in the rent, and when the tenant is responsible for same, direct to the Collections of Rates. This method of payment could not made any difference to owners or agents to sign a form of receipt (copy herewith) and which would be provided by the County showing that the amount named thereon was received from the County Police Authority. it would be more convenient of arrangements could be made for owners, or agents of houses occupied by the Police to receive the rents of such houses monthly, quarterly or half yearly direct from Superintendents and this would save the owner collecting the rents at more frequent intervals, lessen the number of forms of receipt to be signed and simplify the keeping of accounts, The Chief Constable directs that Superintendents will personally interest themselves in this matter at their best to bring about an alteration which is entirely in the interest of married members of the Force. In cases in which tenants are responsible for the payment of rates, the Demand Notes when received by occupiers, would be at once sent out to Superintendents to carefully check same, including assessable value and after satisfying themselves as to the correctness of the amount demanded, submit same for the Chief Constable's approval, afterwards paying same direct to the Collector. If the rents are in future paid monthly, quarterly or half yearly, the correct method of as ascertaining would be to multiply the weekly sum by 52 and divide the answer by 12.4 or 2 as the case may be. The rent for odd days from Sunday 27th March to 31st March 1921, inclusive, will be paid by occupiers as at present Rent Allowance being granted to 31st March 1921 as it is important for the new method of payment to commence on 1st April 1921. A Return on the Form sent herewith showing the result of the efforts in the direction indicated will be rendered to Head Quarters on 31st March 1921. General Order No. 43 18th February 1921 Assizes The Chief Constables notifies to the Constabulary that the next Assizes for the County of Chester will commence for the trial of prisoners at 11a.m. on Saturday 26th February 1921. General Order No. 44 19th February 1921 Evidence The Chief Constable has noticed in the public press that Judges and Justices have lately on several occasions, censured Police witness regarding evidence tendered in Court, also upon the manner in which evidence was given. He wishes every member of the Constabulary to understand that, if they make a statement as to the facts, without any explanation from information received that such is the result of enquiries made, or from information received, they lay themselves open to a charge of giving evidence on oath which cannot be substantial, and which is therefore not permissible as evidence. If thereof any statement be made by a Constable in a Court of Law, either before or after conviction which is not of his own personal knowledge, such statement must be prefaced with the remark "as a result of Police enquiries" or "From information received". A Constable must not, under any circumstances, unless he is asked a question by the Bench refer to an offence with which the prisoner was not charged, or having been charged, or having been charged was found not guilty. Constables must when giving evidence give all the facts within their knowledge whether they are for or against the prisoner and must never suppress anything which might be considered favourable to the prisoner. The Chief Constable directs that this Order be read and explained to all ranks by Superintendents on the first possible occasion and each month for the next six months, a report that this has been so read and explained is to be made in the monthly journal. General Order No. 48 23rd February 1921 The Finance Act and The Roads Act 1920 Registration and Licensing of Motor Vehicles Referring to S.G.O.'s 378/1920 and 15/1921 the Chief Constable forwards herewith copies of the following:- 1. An extra number of copies of: 1. The Home Office Pamphlet 2. The Ministry of Transport Memorandum (R.F.1921) is forwarded to enable one to be supplied to each Section in the County where they must be kept neatly placed in a strong brown paper cover, so as to be available for ready reference by any member of Section. The documents forwarded herewith contain instructions which are in some respects supplementary to those already issued on this subject and Superintendents will explain the necessary parts to all members of their Divisions. Particular attention is drawn to para. 17 and 18 on pages 5 and 6 of the Home Office printed Pamphlet (No. 1 above) regarding proceedings for excise offences those including non -payment of the appropriate excise duty being taken by or under the direction of the Registration Authorities. Reports against persons for this class of offence will be submitted to the Office for transmission if necessary to the County Registration Authority. As explained in the Home Office letter printed pamphlet the new scheme of registration and licensing of motor vehicles does not affect the present law as to the issue of driver's licenses. It is provided however in Section 7 of the Roads Act that when a drive is convicted it will be a matter for the discretion of the Court as they think fit, to order or not to order the conviction to be endorsed upon the license. Moreover, the holder of a driver's license will be entitled if no conviction has been endorsed for a period of three years to apply for the issue of a fresh license free of all endorsements and the license therefore will be no longer provide a complete record of the driver's previous convictions, and through the statutory obligations of the Clerk of the Court to send a notice of the Conviction to the Authority by whom the license was issued will still remain it is desirable that for the purpose of their records of convictions the Police should rely on their own information from other Forces as they do in cases of offences. When drivers of motor vehicles are prosecuted against for offences in Cheshire the Superintendent of the Division in which the offence has been committed will be responsible for searching his own records and for enquiring whenever necessary whether any conviction against such driver so as to be able to furnish information to the Court. Under the new arrangement it will no longer be necessary for the Superintendents to send to this Office or circulate to Divisions on the 1st of each month the information required on Form DD3a. All these Blank Forms now in Divisions will be returned to this Office. The Act and Memorandum will be kept in the Guard Book for Acts of Parliament at Divisional Head Quarters. It must be noted that the Memorandum is not printed by or under the authority of the Kings Printers and cannot therefore be produced in a Court of Law. The new provisions contained in part 11 of the Memorandum are based for the main part on the Defence of The Realm Regulations 18A 22B 4G 43 44 45 48 and 53. Carefully studied and in future proceedings are under the Defence of the Realm for an offence under that Act shall not be instituted except by or with the consent of the Attorney General and this restriction shall apply also to prosecutions for offences which are declared to be felonies, misdemeanours under the Act of 1920. It should be noted however, that offences under Section 4 or Section 5 of the new Act are to dealt with under the Summary Jurisdiction Acts and the understand that proceedings will not b of the Attorney General will not be necessary for the institution of proceedings under those Sections. General Order No. 55 8th March 1921 Additional Increments for Long Service and Efficiency The attention of the Chief Constable has been drawn by the Home Office to Regulations 58/ 61/ and 63/ of the Police Regulations which relate to his Authority to grant to Constables Additional Increments after 17 and 22 years- service: The Home Secretary desires it to be understood that these increments are intended to act as an incentive to Constables (who have not yet received promotion) to maintain the highest standard of discipline and efficiency. The Secretary of State stipulate that the increments are not to be automatically granted or retained. Each grant and the retention of the Increment is dependent on the good conduct and efficiency of the Constable as shown by his work from day to day, as shown by his readiness to meet special demands on his time. Name of prisoner (name under which he is in prison) 2. Prison in which he is confined) 3. Particulars of committal to prison or the trial showing Court date offences and sentence or Order of Court, (state Court) if for trial state Court or probable date of trial. 4. Place and time when the production is required. 5. Name under which prisoners will be charged. 6. Particulars of case in connection with which production is desired and reason for producing prisoner current sentence.. 7. Any other information in possession of Superintendents. General Order No. 61 12th March 1921 Incendiary Fires Owing to a number of Incendiary fires recently taken place in the County and adjoining Police Districts which evidently been caused by persons working under a system, the Chief Constable has been considering the practicality of arranging for "Rocket Signals" to be given by the Police upon further outbreaks taking place, with a view of warning Police Special Constables and the public generally, but particularly farmers in as large area as possible in order that steps may be quickly taken by all concerned for security if possible the arrest of the persons committing these depredations, and warning farmers that incendiaries are about so that they may take steps to afford efficient protection to their farms. A few rockets have therefore today been sent to Altrincham, Wirral, Stockport and Runcorn Divisions, and others will be forwarded next week for use, as necessarily arises in the remaining Divisions. The Chief Constable directs that upon receipt of the rockets they will be distributed amongst Sergeants of Rural Sections and isolated Constables in Rural Districts with instructions for one to be fired immediately upon being satisfied that incendiary fires have occurred. Superintendents will warn all ranks accordingly and see that they are made acquainted with the object which the Chief Constable has been introducing these signals. The Chief Constable wishes Special Constables and the public generally to understand that upon the discharge of one of these rockets it is most important for them to do they can to prevent the escape of the incendiaries and to warn farmers of immediate danger. The makers of the rockets have strongly advised that the discharge should be affected by means of a fuse match and not with an ordinary match. The instructions on the rockets must be carefully perused and acted upon and those concerned must use great care in running no risk. Two sorts of rockets are sent all being white in colour: Red and Green rockets will be sent in the course of the next few days. Of the rockets now sent the small rockets go with the small poles and the larger with the larger pole. To prepare them for firing the pole must be well rammed into the rocket. To fire the rocket the pole with the rocket at the top and should be leaned against a fence or gate with the nose clear of any bar or hedge. The pole of the rocket must be on no account be fixed in the ground as the whole rocket goes up into the air. To light the rocket it is necessary to at first open the fuse which is marked upon it and if need be to cut it open with a pen knife. After the rocket has been placed in position to fire leaning against a fence or gate the fuse should be lit with a fuzee, the person who lights the fuse standing well back so that the rocket and pole can go straight into the air. The smaller rocket can be seen for a distance of about a mile and a half, the larger for a distance of about five miles. Only one rocket is to be sent up and that by the Police Constable who is first on the spot, and who is satisfied that the fire is caused by incendiary. General Order No. 62 14th March 1921 "Confidential" Journey Of Their Majesties The King and Queen through Cheshire on Wednesday 16th March 1921 On Wednesday 15th March 1921 Their Majesties the King and Queen will leave Euston Railway Station, by Special Train at 1.30p.m for Huyton, Lancashire, and will pass through Cheshire by the London and North Western Railway and entering the County of Chester at the boundary between Cheshire and Staffordshire at the South side of Crewe Railway Station at about 5p.m. (train stops for a few minutes) travelling via Crewe, Winsford, Acton Bridge and Runcorn. Having regard for the circumstances of the present day the Chief Constable directs that special precautions as to watching bridges will be taken and all Constables and Watchers will be at their posts at 4.30p.m.on 16th March 1921. The portion of the Line, the Railway Arches, Bridge's, etc. to be travelled over will receive special attention at irregular intervals during the previous 24 hours. General Order No. 67 17th March 1921 Duty Scales The Chief Constable directs that from the 1st April 1921 Duty Scale "B" will be worked by all Divisions. In the event of Superintendents considering it necessary to alter the Duty Scales in consequence of any local occurrence they will do so and report cause to the Chief Constable. General Order No. 68 17th March 1921 Incendiary Fires Rockets Referring to G.O. 61/21 The Chief Constable will as early as possible forward a further supply of Red Rockets White Rockets and Green Rockets and he directs that the same will be carefully distributed as the Superintendents think best and used as laid down in the Order above referred to: With a view of preventing the possibility of well-disposed persons firing Rockets in Order to mislead the Police and others the Chief Constable desires that different colour Rockets will be fired on certain nights as follows:- Friday, Saturday and Sunday (White Rockets) Monday and Wednesday (Red Rockets) Tuesday and Thursday (Green Rockets) If the supply of the correct coloured Rockets in the possession of any Member of the Force falls short on any particular night he is not to hesitate to send a Rocket of another colour, but he will explain to his Divisional Head Quarters as quickly as possible the reason for the deviation from the General Order. On no account is any member of the Force below the rank of Superintendent to communicate to any one any information s to the colour of the Rocket to be used. Special Constables and other Watchers will no doubt turn out if any sort of Rocket is fired. General Order No. 69 17th March 1921 Automatic Pistols Referring to the six automatic pistols and ammunition therefore which have been forwarded to Divisions the Chief Constable now directs that the pistols and ammunition will be issued by the Superintendents to six carefully selected and experienced members of the most likely to require armed Police Patrols during the night time. Great care must be exercised in making the selection of the men to whom the Pistols are to be handed and Superintendents must satisfy themselves that such men are cool headed and fully capable of loading and unloading the Pistol. The men should be clearly warned that these arms are to be un-loaded and put away in safety as soon as the Constable goes off duty. and special care is to be taken to ensure that when the pistol is unloaded a cartridge is not left in the barrel. "Carelessness" in this respect had been the cause of frequent accidents. The muzzle of the pistol when held in the hand is to be pointed upwards or downwards and in such a manner that the discharge cannot endanger any person if it should take place accidently. It must be clearly understood that there is no justification for firing with a bullet unless the Constable is assured that his life is in danger or that a serious outrage has been committed, and the depredator is making an escape. When an offence has been committed it is always the primary duty of Constables to arrest the offender and bring him before a Court of Punishment, and a Constable is not justified except under such circumstances as have been outlined, in firing at an individual. If the Constable can regulate his aim when he fires he should do so as to maim and not kill. General Order No. 70 17th March 1921 Promotion Appointment and Transfers Consequent upon Inspector Foster stating his inability to move from the hose in New Ferry Police Station the promotion of transfers named in G.O. 57/1921 must be held in abeyance Estimates for removal need not at present be obtained. A telephone message will be sent as soon as possible fixing the date of both promotion and transfer. General Order No. 71 17th March 1921 Payment of Rent of Houses occupied by the Police Referring to G.O. 42/1921 and to the Returns rendered therewith the Chief Constable has pleasure in intimating that with one or two option the owners and agents of houses occupied by the Police have, thanks to the personal efforts of the Superintendents 9for which the Chief Constable records his thanks) agreed to accept the rent either half yearly or quarterly or monthly and to sign the Constabulary form of receipt for same. He therefore directs that the new arrangements laid down in G.O. 42/21 will be brought into operation from 1st April 1921 the rent for odd days at end of present quarter i.e. from 27th March 1921 to 31st March 1921, being paid by the occupiers who will receive Rent Allowance the latter date as per the paid, but one of the G.O. referred to. Superintendents will in future pay the rents to the owners and agents of the houses (not though the tenants) at the previous agreed upon them and obtain receipts) at the periods agreed upon and obtain receipts at the for the amounts paid on Form F3 (a supply to follow) It will be necessary for the amounts paid as rents and rates where (such are paid in the rent) to be summarised quarterly and for this purpose a new form (supply to follow) will be utilized. The total amounts on Form F4 will be entered in the Cash Books quarterly and at the end of June, September, March and December and Form F/4 and the receipts attached thereto, will be given one voucher No. only. In cases where the rents are paid monthly each of the three months will be entered separately on Form F3 attached thereto. Where rents are paid quarterly one entry and one receipt will be sufficient half yearly rents will be entered on the appropriate quarters F/4 and receipts attached. The weekly rents will be calculated per month, quarter or half yearly is directed in G.O. 42/21 multiply the weekly sum by 52 and divide the answer by 12, 2. or 4 as necessary. In making the calculation Superintendents will when the fraction is a half penny all the penny but when it is less than a halfpenny the fracture will be dropped. Whenever the amount of weekly rent is increased or otherwise the variations will be shown on Form F/4 as it is at present done on form F/19 but one receipt will be sufficient. Applications for increase of rent will, when necessary be on Form F/2 the words "Aid in payment of" in heading being crossed out in red ink and the word "Increased" or whatever will be substituted. The Demand Notes for Rates payable by Constables when not included in the Rent will upon receipt be forwarded to the Superintendents and after being carefully checked and endorsed in red ink at the Top with the name and address of the Constable occupying the house after which the amounts will be paid by Superintendents direct to Collectors and the Demand Note and receipt be attached to Form F4. Superintendents will understand that the rents up to the end of the year each quarter must be paid in sufficient time to be included for the accounts for that quarter. Nearly all the owners and agents of houses occupied by the Police having agreed to receive the rates quarterly or half yearly and to sign the Constabulary Form of receipt: Superintendents will recognize that it would be of great convenience so far as the Police Accounts are concerned, if the few who have suggested monthly or weekly payments could be induced to receive the rents quarterly from the 1st April 1921 and the Chief Constable hopes that a further effort may be made to bring this about. Form F/19 will continue to be used for the allowance granted to Constables occupying furnished apartments or those receiving lodging allowance. General Order No. 74 18th March 1921 Alteration of Time The Chief Constable intimates to the Constabulary that His Majesty's Government have decided that in the night of Sunday 2nd and 3rd April 1921 at 2a.m. the time on all railways, Post- Offices and other Government Establishments will be put forward one hour to 3a.m. The altered time will be used for all ordinary purposes during the summer: For Instance licensed houses and workshops and other establishments where houses are regulated by law, will be required to observe the altered times. The Government request the public to put forward all clocks and watches by one hour during the night of 2nd April 1921 and Superintendents and all other members of the Constabulary will arrange for their own watches and the clocks at Police Stations and Magistrates Rooms throughout the County to be altered accordingly. Normal time will be restored at 2a.m. on the morning of Monday 3rd October 1921. The hour reckoned by "Summer Time" at which such an Order take effect will therefore in all cases be one hour later than when reckoned by Greenwich Meal Time and he directs that care will be taken to allow for this when using lighting up Tables or Tables giving the hours of local sunset calculated for Greenwich Mean Time. General Order No. 75 22nd March 1921 Liquor Control Regulations 1915 Lancashire and Cheshire Area The Central Control Board (Liquor Traffic) have issued a General Order 18th March 1921 regulating the sale of intoxicating Liquor on Good Friday in England and Wales This Order applies to all Areas or parts of areas in England and Wales to which the Defence of the Realm (Liquor Control) Regulations 1915 have been applied. The provisions of the Order so far as Cheshire is concerned are as follows: The hours during which intoxicating liquor may be sold and supplied on Good Friday on or off the premises are the same as on Sundays. No. spirits to be consumed off the premises shall be sold or supplied in any licensed premises or clubs or to be dispatched or taken therefrom on Good Friday. A copy of the Order is forwarded herewith for each Superintendent and the Chief Constable directs that all license holders and Secretaries of clubs will be informed of the contents of same. General Order No. 76 23rd March 1921 Census Of England & Wales 1921 The Right Honourable The Secretary of State Home office having agreed that it is a very desirable that the Police should assist the Census Office in enumerating homeless persons on the night of 24th April 1921 the Chief Constable directs that such work will be performed during the ordinary night patrol by reliable members of the Constabulary by suitable members of the Constabulary to be selected in each Division of the Constabulary. In Towns and Urban Districts it may be necessary in some cases for two or more Constable to be engaged in searching all likely places where homeless persons may be found, and in Rural Districts and the local Constable should, where necessary be assisted by one or more Constables to be detailed by Superintendents so that likely places may more efficiently searched. It will be that all homeless persons found sleeping in barns, sheds, haystacks or unused Railway under the arch or on a stairway accessible to the public or in the open air, will be included in the Schedule but of course a Constable can take down the particulars in the Official Note book, and subsequently transcribe them on the prescribed Form. Special Forms will not on this occasion, the Chief Constable therefore directs that Superintendents will obtain as early as possible, next month from the District Registration of Births and Deaths in each locality a sufficient number of Forms so that the full particulars of all homeless persons may be entered thereon Two lines of the Form should be used for the particulars relating to each person Columns (a) and (b) of the second line being used for the place and description where found. Smith On a Stairway 29 In the event of no homeless persons being found or met with the Return will be marked "Nil" by the Constables engaged in the search. These Constables will carefully read the instructions printed on the Return in order that there may not be any. Non dwellers, persons sleeping in tents, or person who at some time of the Census night resort to casual shelters or common lodging houses must not be included in the Return as the Return will be enumerated by the ordinary enumeration. If full particulars cannot be obtained from any person each person must not be omitted on that account but "N.K" (not known) should be entered in the columns for which the information is not available. The name of the Constable who recorded the particulars and the address of the Police Station from which the form was issued will be inserted in the space on the back of the form. All the Returns will be collected by Superintendents on Monday 26th April 1921 and after examining same to see that they are all correct and the columns properly filled in and the Return (those filled in and those marked "Nil") will be forwarded the same day to the Local Register of Births and Deaths in each district, a report being forwarded to Chief Constable on the night of 25th April 1921 that such has been done. It will be understood that the Census enumerators must have the support of the Police and their personal assistance if occasion should arise, more especially in low neighbourhoods and Superintendents will warn all ranks that if they are appealed to the enumerators or any of them assistance must be forthwith rendered. In order to receive the complete enumeration of all persons in Station Houses or lock-ups on the night of Sunday 25th April 1921 a schedule will in the ordinary way be applied to each Police Station and will be filled in by the occupier and the names and other particulars of all persons confined there on that night, and delivered to the enumerators calling at the station. The next morning the attention of all Constables who are on duty and returning home the following morning is called to the fact that particulars as to them and their families should be entered on the Schedules which will in the ordinary way be left at their homes by the Enumerators of the Districts in which they reside. General Order No. 78 29th March 1921 Tarporley Hunt Meeting 30th March 1921 Arrangements have been made for two good meals to be supplied at the expense of the Tarporley Hunt Committee to those members of the Force performing "Special Service Duty" at the above Meeting. "Refreshments Allowance" under Regulation of the Police Regulations cannot be allowed as the men will not necessarily be put to expense in obtaining food away from home. The Superintendent of the Eddisbury Division will make arrangements for those members of the Force detailed for "Police Special Duty" to obtain two good meals at such times as the men can spared from duty, for the payment at which they will themselves be responsible and will consequently be granted Refreshment Allowance for the two meals in accordance with the Regulation 71. Separate forms F17 marked "Special Service Duty" respectively will be submitted to Head Quarters on 4th April 1921. The "extra hours" duty which must necessarily be performed on the day by the Inspectors, Sergeants and Constables engaged on "Special Service Duty" and "Police Special Duty" will be allowed as "Time Off" day duty one or two hours at a time, on the most convenient days to be arranged by Superintendents, between the 1st and 14th April 1921. Any members of the Force who has not been granted the "extra hours" as "Time Off" will report the fact through Superintendents to the Chief Constable and in submitting such report if any. Superintendents will explain the reason for non-compliance with these instructions. General Order No. 81 1st April 1921 Firearms Act 1920 Order of the Secretary of State Prohibiting removals of Firearms and Ammunition The following is a copy of an Order made by the Secretary of State, Home Department under Section 9 of the above Act: Firearms and Ammunition "Order of the Secretary of State dated 24th April 1921 prohibiting removals (Firearms Act 1920) 1. In pursuance of the powers vested in me by Section 9 of the Firearms Act 1920 I hereby make the following Order. 1. The removal of any firearms or ammunition from Great Britain to Ireland is prohibited unless such removal is authorised by the Chief Officer of the Police of the District from which the firearms or ammunition are to be moved. 2. The removal from one place to another in the United Kingdom or any firearms or ammunition intended to be removed subsequently to Ireland is prohibited unless the removal is authorised by the Chief Officer of the District from which the firearms and ammunition are in the first instance to be removed. 3. This Order shall apply to all firearms and ammunition and to all modes of conveyance. The Chief Constable forwards herewith:- 1. Special attention to be drawn to the following:- The New Order comes into operation on 30th March 1921 (on which date Regulation 31of the Defence of the Realm Regulations ceases to have effect) and covers all firearms and ammunition (including smooth core shot guns and guns and ammunition intended for removal to Ireland. It will not be necessary for Officers in H.M. Forces in possession of special passes or permits to obtain a Police Authority to take firearms or ammunition to Ireland, but this exemption does not cover the purchase of same. All applications for "authority to remove" will be forwarded to this Office as soon as received, care being taken that the forms are correctly filled in, in every particular and Superintendents will when submitting the applications report:- Whether they know of any reason why "authority" should not be granted. 2. Date on which it is proposed to remove the firearms or ammunition. No authority will be granted by the Chief Constable unless the applicant produces a written authority (which will be attached to the form of application) for the possession, use, of the forearms and ammunition in Ireland) under the Restoration of Order in Ireland Regulation 31. In the present condition of Ireland it is of utmost importance that vigilance should be exercised throughout Great Britain to detect movements of firearms and ammunition likely to be intended for Ireland and it will be seen on referring to Section 9 (3) of the Act that power is given to the Police to deal with any case where there is reason to believe that Article 2 of the New Order is being contravened. After full discussion it was unanimously decided by all representatives from 1st January 1921 the voluntary subscriptions should be as follows: Superintendents 6d- per week Inspectors 5d/- per week Sergeants 4d/- per week Constables 3d/- per week And the representatives present undertook to their best to secure uniformity on these lines so as to place the finances of the institutions named on a sound footing. General Order No. 87 2nd April 1921 Serious Crime Having regard to the suggestion that Motor Cars are being made use of especially after dark and in the early hours of the morning to convey persons bent on committing serious crime such as Incendiarism, the Chief Constable directs that Constables will be warned to most carefully note the Identification Plates of the Motor Plates of motor cars which they may see during the night and early morning. Constables are not to hesitate under the circumstances of the day, to stop cars which they do not recognise during the above named hours and to not only take particulars of the car and the drivers licence etc. but also note a quickly and briefly as possible the number and class of persons who occupy the car. This duty is of the utmost importance and will require to be performed with consideration. If any Constable has reason to suspect that the occupants of a car are on evil intent, he will at once communicate his suspicion to the Police on the route which the car is taking and, if circumstances require it he will be justified in firing a Rocket. General Order No. 88 2nd April 1921 Telephones at Police Stations The Chief Constable draws the special attention to Superintendents and other members of the Constabulary occupying Police Stations to the new rate of charges for "Telephone Calls" which come into operation on 1st April 1921 and to the fact that from 1st April 1921 and to that in future "Every Call" made whether on the trunk or local call will be or otherwise, charged for the lowest amount being three half pence per call and increasing to a considerable sum according to distance. In order that the police may be able to properly check the accounts as submitted and certify same to be correct or otherwise it will be absolutely necessary for a careful record to be made in the book kept for the purpose at each police Station of all calls including town or village and whenever the Police "ring up" the necessary entry must be there and then be made in each of the ruled columns in the said book. Attention is again drawn to the necessity of great care being exercised in using the telephone and it must be distinctly understood that those making will be expected of so directed to be able to fully justify the same by the urgency or importance of the message. Chapel Brow Tintwistle No. 77 Three Tuns Hazel Grove Licensee George Martin General Order No. 90 5th April 1921 Registration and Licensing of Motor Vehicles The Road Vehicles (Registration and Licensing Regulations 1921 Referring to S.G.O.'s 48/1921 and the General Orders therein referred to the Chief Constable forwards herewith copies of the following:- 1. Provisional Rules and Orders containing The Road Vehicles (Registration & Licensing) Regulations 1921 dated 9th March 1921. 2. Home Office Circular dated 30th March 1921 No. 412.533/26. 3. Copy of Official Notice to the Press issued by the Ministry of Transport as to enforcement of the Roads Act 1920 and the Provisional Regulations referred to above and he directs that the same will be carefully perused by Superintendents and kept with other documents forwarded to with the General Orders above at Divisional Head Quarters. An extra number of copies of the Regulations (No 1 above) is forwarded to each Section in the County where they must be placed in brown paper cover with the Home Office printed Pamphlet (referred to in General Order 48/1921) so as to be available for ready reference by any member of Section. The documents forwarded herewith contain instructions which are in some respects supplementary to those already issued. The necessary parts of same to all members of their Divisions;- Particular attention is drawn to the Orders or parts of Orders which are revoked by the Schedule of the Regulations All licenses applied for by applicants prior to the 31st January last have now been issued, by the Licensing and Registration Authorities and the provisions of the Acts and Regulations should now be enforced, but the Minister of Transport has suggested to Registration Authorities that it may be desirable at first to deal with any infringements of the Regulations by a warning merely and not to take proceedings until Owners of Motor Vehicles had reasonable time to make themselves familiar with the new provisions. This will apply particularly in the case of Regulation 33 relating to Hackney Vehicles, as it may not be practicable for some little time to obtain Hackney carriage plates of the prescribed forms. The attention of the Constabulary is drawn to the following points:- 1. The position of the license on Motor Cycles. Regulation 4 (3) (a) requires that the license shall be carried in a conspicuous position on the near side of the vehicle. In the case of cycles with a side car attached on the off side no question arises, the license must be exhibited on the near side of the Cycle, but in the case of cycle, with a side car attached to the near side it has been decided that the combination may reasonably be regarded as one vehicle, and that the license may be exhibited either on the near side of the cycle, provided it is not obscured by the side car or on the near side of the latter. The requirements may also deemed to be complied with if the license is carried on a glass wind-screen on the side car in the same way as is permitted in the case of a motor car. 2. Quarterly Licenses:- It has been decided that the licenses issued to cover the second quarter of this year (from 25th March to 30th June will be coloured green. 3. General Identification Marks:- Representations have been made that the size of the General Identification Mark plates prescribed for use in Motor Cars is such, that, in the case of small cars with little ground clearance, it is sometimes difficult to attach the front plate without either interfering with the radiator or rendering the plate liable to damage by occasional contact with the road. It has therefore been decided that in the case of Cars not exceeding 10 horse- power, the smaller plates prescribed for Motor Cycles may be used. 4. Particulars entered on License:- Among the particulars to be inserted on the license before issue, under Regulation 13 (ii) are "horse power maximum seating capacity, or weight un-laden (as the case may require) in respect of which duty has been paid" It is understood however, that in many cases the actual horse-power, seating capacity or un-laden weight has been inserted e. c. the horse -power is shown as 15.9 instead of 16 on the seating capacity as 8 instead of 14, though the higher limit is equally covered in each case by the duty paid. As explained in paragraph 26 of the Home Office Printed Pamphlet forwarded with S. G. O. 48/21 payment of duty at a particular rate covers the vehicle, as long as the maximum limits for which that amount of duty is payable, not exceeded and it is important that the Police should have this in mind. 5. Hackney Carriages -Seating Capacity:- (a) From an Excise point of view no objection will be raised to two young children carried in vehicles licensed as Hackney Carriages, being treated as one adult. Any question however, which may arise from a public safety point of view as to whether a vehicle is overcrowded, or does not otherwise comply with the Local Hackney Carriage Licensing Authority and the Police. (b) Under Section (ii) 2 of the Roads Act 1920 if a person who has taken out a license for a vehicle at the rate of duty applicable to a Hackney Carriage seating not more than a certain number of persons, is liable to penalties, if the vehicle is used for seating a larger number of persons, but it has been decided that no Excise offence is committed if additional passengers over and above the number for which the license has been issued are carried, Standing:- This however will not absolve the licensee from any offence he may thereby commit by overcrowding or infringement of the conditions of any license to for hire. (6) Identification Letters and Numbers:- In the case of certain Counties and County Boroughs in Ireland a list of which is given below, some of the duties of the County Council under the Roads Act and under the Motor Car Acts 1896 and 1903 will be performed by the Police, and not by the Council. If it is necessary to make enquiry in connection with any motor vehicle bearing the Index Mark of one of these Counties or County Boroughs, the communication should be addresses to the County Inspector of Police, or in the case of Dublin to the Commissioner of the Dublin Metropolitan Police. General Order No. 100 18th April 1921 Attempts to undermine discipline & Loyalty of the Naval H. M. Forces and The Police Force The Chief Constable has received intimation that the attention of the Naval and Military Authorities has been drawn to several cases in which attempts have been made to undermine the discipline and loyalty of individual members of His Majesty's Forces by persons engaging them in conversation in the streets and elsewhere. These men have reported these incidents to their superior Officers but in the meantime the opportunity of tracing the offenders has been lost, and as at the present time the Authorities are bound to regard as particularly serious. any attempt to cause sedation or disaffection among any of His Majesty's Forces, The War Office and Admiralty are issuing instructions to the effect that, if any soldier or sailor is approached by anyone who has attempts to undermine his loyalty or dissuade him from carrying out his duty, he is to hand him over to the Police. The Chief Constable therefore directs that Superintendents will draw the special attention of all Members of their Divisions to No. 19 of the Emergency Regulations forwarded with Memo to Superintendents of 9th April 1921 which reads as following:- "19. If any person attempts or does "any act calculated or likely to cause "military, sedations, or disaffection among "any of His Majesty's Forces or among "any the members of the Police, or, any fire "brigade, or among the civilian population, "or to impede, delay or restrict any "measurers taken for securing and regulating "the supply or distribution of food "water, fuel, light, or other necessities "for maintaining the means of transit "or locomotion, or for any other purposes "essential to the public safety, or the "life of the community, he shall "be guilt of an offence against "these Regulations. Provided that a "person shall not be guilty of an "offence under the Regulation by reason "only of his taking part in a strike " or peacefully persuading any other "person to take part in a strike". And instruct them that if a Member of His Majesty's Forces hands anyone over to them, and can give evidence in support of a charge under the Regulation, the person should be taken into custody and charged. If the evidence does not appear sufficient to justify arrest the person's name and address, and any other particulars, are available should be at once reported to the Chief Constable. Similar action should be taken in case of any person attempting to undermine the loyalty of an officer. General Order No. 101 19th April 1921 Road Fund Licenses and Local Taxation Licenses The Chief Constable forwards herewith a supply of Forms R.F/12/10 which takes the place of Form No. 4 made under the Local Taxation Licenses, and he directs that the appropriate Form will be used in reporting offences by owners of motor vehicles and horse drawn carriages of not taking out the necessary licenses under the Roads Act. Forms No's 1, 2, 3 and 5 under the Local Taxation Licenses now in possession of "Observation Officers" will continue to be used in the ordinary way. In the event of a person being reported for more than one offence, one of which is either keeping a Motor Vehicle, or keeping a horse drawn Carriage, without the necessary license, the offence of keeping the motor vehicle and keeping the horse drawn vehicle will be entered on separate Forms R. F. 12/10 and R. F. 12/11 respectively, and the other offence on the appropriate form, No. 2, 3, or 5. Should a person be reported for using Armorial Bearings and employing Male Servants without Licenses, then the two offences will be entered on Form No. 1. Superintendents will hand to the Inspectors who are appointed "Observation Officers" a supply of the accompanying Forms. The old Form No. 4 now in possession of Observation Officers will be forwarded to this Office on 22nd April 1921. General Order No. 114 29th April 1921 Liquor Control Regulations 1915 Lancashire and Cheshire Area Referring to General Order 31/1916 to those which have subsequently been issued on the above subject, the Chief Constable forwards herewith a supply of copies of a new General Order (Amending and Consolidating) Central Control Board (Liquor Traffic) for all areas in England to which the Defence of the Realm (Liquor Control) Regulations 1915 have been applied, other than the London, Midlands, Staffordshire and West Gloucestershire Areas and the County of Monmouth (including the County Borough of Newport). The Order comes into operation 0n 2nd May and applies to the following amendments of the existing restrictions of the Board in which haven made in the Order. 1. Article 3(a) By permitting the sale and supply of spirits for consumption off the premises between 12 noon and 2.30p.m on Saturday, removes the existing prohibition of such sales on that day. 2. Article 3 (b) Now merely requires that spirits to be consumed off the premises shall not be taken from licensed premises or clubs in any open vessel. The provisions which fixed the reputed quart as the minimum quantity of spirits which might be sold for consumption together with the requirements as to the labelling of bottles, is repealed. 3. Article 6 (a) Extends the hours after 10p.m. for which the Magistrates may grant an Order or License in pursuance of Section 57 or Section 64 of the licensing (Consolidation) Act 1910. 4. Article 9 Limits the extent to which spirits may be diluted without notice to the purchaser to a strength falling between 30 and 35 up instead of to a strength falling between 30 and 50 u.p: It will therefore be illegal to sell spirits diluted below 35 u. p. without notice to the purchase. 5. Article 11 Substitutes for the requirement that copies of the Boards order must be exhibited in every club and every public room in Licensed Premises, the requirements that copies must be kept on the premises or club and produced for inspection as therein specified. The Chief Constable directs that a copy of the Order will be distributed without delay to all licensed premises, and clubs within the jurisdiction of the Cheshire Constabulary, and when serving the Order on the Licensee or Secretary of a Club, the Police will draw attention to the requirements of Article 11. General Order No. 145 10th June 1921 Statutory Rules and Orders 1921 No. 906 Road Vehicles The Minister of Transport has made an Order dated 19th May1921 as follows:- The Heavy Motor (Amendment) Order 1921 dated 19th May 1921 made by the Minister of Transport. Tudor £ 5. 5. 6 Runcorn PC 414 Cheers £ 3. 12. 0 General Order No. 156 1st July 1921 Registration and Licensing of Motor Vehicles The Roads Vehicles (Registration Licenses) Regulations 1921 Referring to S.G.O.'s 90/1921 forwarding copies of the above Regulations, the Chief Constable has been informed that, in view of representation received, the Minister received, the Minister of Transport has under consideration the question of relaxing the provisions of the Regulations 21 and 33 of the Road Vehicles 9Registration and Licensing) Regulations 1921, requiring the use of a plate of the prescribed pattern for the use index mark and registration number to be exhibited on motor vehicles and the additional plate to be carried on hackney vehicles and for the present pending amendment of the Regulations the Minister has asked that the Police should not take proceedings in cases where the required marks are painted or otherwise displayed on the vehicle so as to be easily distinguishable, though not on plates affixed to the vehicle as required by the present Regulations. The Minister of Transport has also intimated the exhibition of the hackney carriage plate prescribed by the present Regulation 33 will, in the revised Regulations be required only in cases where the duty payable by reason of the vehicle used as a hackney vehicle, is less than the duty at the horse-power rate. For example, the hackney mark will be required on a 45 h. p. car licensed as a hackney carriage to seat nor less than six persons but not on a 10 h.p. hackney carriage. The weapons are not on any account to be produced unless necessity actually arises and will be un-loaded with the muzzle facing in a safe direction, as soon as each man goes off duty at the Castle, the cartridges being carefully counted to ensure that one is not left in the barrel. The weapons will be carefully loaded before again resuming duty at the Castle. In order to augment the above number of armed Constables on duty, those members of Constabulary attending the Assizes as prosecution or witnesses and who are proficient in handling an automatic Pistol or small revolver will be supplied with same (together with ammunition therefore) as far as possible by the Superintendent of the Division to which they belong, and Constables concerned will be careful to carrying and un-loading the weapon. Upon return to ordinary duty the Automatic Pistols and Revolvers, also the ammunition will be at once returned to the Superintendent who will report to the Chief Constable that he has received same correct. General Order No. 160 1st July 1921 Journey Of His Royal Highness The Prince of Wales Through Cheshire on 4th July 1921 and Return on Friday 8th July 1921 On Monday 4th July His Royal Highness the Prince of Wales will leave Euston Railway Station, by ordinary train at 5. 20p.m. for Huyton, Lancashire and will pass through Cheshire by the London and North Western Railway and entering the County of Chester at the boundary between Cheshire and Staffordshire at the South side of Crewe Railway Station at about 5p.m. (train stops for a few minutes) travelling via Crewe, Winsford, Hartford, Acton Bridge and Runcorn. On Friday 8th July 1921 His Royal Highness the Prince of Wales will leave Wigan Railway Station at 6. 45p.m. by ordinary train for London and will pass through Cheshire pass through Cheshire by the London and North Western Railway via Acton Bridge, Hartford, Winsford and Crewe, leaving the County about 7. 35p.m.. General Order No. 164 7th July 1921 Government Inspection 1921 The usual instructions laid down in General Order 82/1883 will be observed. Books will not be placed in front of the men on parade but will be kept inside the Police Station ready for inspection;- Leggings Issue will not be worn but be produced with Great Coats and Capes in straps and be placed three paces in front of each man. Section 72 of the Highways Act 1835 would appear to give power to take proceedings against any person causing injury to be done to the highway or the hedges, posts rails, walls or laying ashes on the highway, to the injury thereto, or the injury interruptions or personal danger to any personal damage of any person travelling thereon. General Order No. 176 14th July 1921 Lights on Vehicles The Chief Constable has observed that in the same Divisions when persons in charge of vehicles including, bicycles, fail to carry a front light and a rear light, two separate summonses are issued for these offences and in order to ensure uniformity in this matter throughout the County he directs that two information will not in future be laid but only one, and that for not carrying a lamp showing a white light to the front. When the case is heard, the Constable will state in his evidence for the information of the Justices that the Defendant, in addition to having no front light did not carry a rear light. General Order No. 182 18th July 1921 Firearms The Chief Constable forwards herewith copy of Home Office letter dated 14th July 1921 No. 415, 089/2 and copy of an instruction issued by the War Officer, to Army Commands concerning Service Firearms, and he directs that whenever the loss, theft or recovery of any Service Firearm is reported to, or comes to the knowledge of the Police or whenever such arms are found to be in possession of persons who should not be in the possession of them, full particulars will at once be reported to this Office in order that the Chief Constable may communicate with the Commissioner of Police of the Metropolis as requested in the Home Office letter. C, Houlgrave £ 4. 15. 0 General Order No. 204 3rd August 1921 The Finance Act 1920 and The Road Act 1920 Road Fund Licenses Referring to S. G. O. 48/90/ 21 and the General Orders referred to therein, the Chief Constable has been informed that in a number of cases have been brought to the Minister of Transport in which the road fund Licenses available for the quarter from July to September, which are issued on pink coloured paper, have been faded to white, owing to some defect in the colouring matter. The arrangement whereby different colours are used in the licenses, valid for different periods, was adapted was adapted merely as a matter for administrative convenience, and the colours have not yet been prescribed by the Roads Act 1920, or the Regulations made thereunder. The fact therefore that a license may have lost its colour does not affect the visibility or under the license liable to any penalty, provided that the particulars thereon are legible and the Minister of Transport has asked that the attention of the Constabulary may be drawn to this point. Different considerations, however, apply as regards the entries in the license of the Regulations made by the Minister of Transport forwarded with S.G.O. 90/1921, and if a license is used on which they have become illegible from any cause, the license is liable to penalties. It has been found that the entries on the licenses issued by some Licensing Authorities, have faded owing to the use of the unsuitable ink, but it is for the licensee to take steps for the replacement of a license which has become defective, and special arrangements have been made by the Ministry for facilitating such replacements, and for the issue of a duplicate license free of charge, where the defect is not due to neglect or fault on the part of the licensee. The Ministry of Transport has requested that a period of grace of fourteen days may be allowed for a license after expiry, that is to say that proceedings should not be taken where a vehicle has been licensed is driven within fourteen days of expiry of the license without a fresh license having been obtained, but this concession is subject to a fresh license being taken out in due course. Any cases observed by the Police should therefore be reported to this Office for transmission to the County Registration Authority, so that the Authority may satisfy them-selves that the fresh license is in fact obtained within fourteen days. General Order No. 208 8th August 1921 Motor Vehicles Registration Referring to S.G.O. 90/1921 and the General Orders therein referred to therein the Chief Constable has been informed that attention has been drawn to a number of cases in which vehicles have been found on the roads, without a license pr with no proper identification number but marked with the Words " For Registration" reliance being placed on the concluding paragraph of Section 6 (a) of the Roads Act 1920 which provides that a person shall not be liable to a penalty for driving an unregistered vehicle if he proves that "He has had a reasonable opportunity "of registering the vehicle, and that it "he has had no reasonable "of registering the vehicle, and that "is being driven on a public road for the "purpose of being so registered" The Home Secretary thinks it very desirable that the Police should take all possible steps to prevent all improper advantage being taken of the provisions referred to, and the Minister of Transport concurs in this view, and it is pointed out in the first place that the provisions referred to, covers only a case where the 1.that he has had no reasonable opportunity of registering the vehicle, and:- 2. that it is being driven on a public road, for the purpose of being so registered, and the Home Secretary is advised that the cases where these conditions are satisfied must be very few, and, indeed, can hardly arise at all for the following reasons:- With regard to them having been reasonable opportunity to register the vehicle, a purchase will, in most cases have arranged acquire the vehicle some days before he takes delivery, and in these circumstances, he can obtain a Declaration Form at any Post Office, as certain the necessary particulars from the Vendor and register the vehicle, and obtain the license, his license and get his number allotted through the post. In order to meet cases urgency where there has been no time, to register a vehicle before delivery the Ministry of Transport requested all Registrations Authorities in January last to facilitate the prompt issue of licenses in the following cases:- (a) To enable a dealer to obtain a license for a vehicle which he has sold, the License being afterwards transferred to the purchaser in the ordinary manner. (b) To enable a purchaser to obtain a license for a vehicle notwithstanding that, at the time of the application, it is not "domiciled" in the registration area, in which he intends to keep it. ( c) To enable am applicant to obtain a license for a vehicle of which he cannot furnish the full registration particulars, proved he can furnish sufficient information to enable the proper amount of duty to be assessed the appropriate license in connection in such case the license will not be issued. Apart from these arrangements to facilitate registration, most cases can, in practice be covered by the use of a general identification mark license as provided for in Regulation 29. There appears therefore to be few cases, if any, there can be any good for driving a vehicle to be registered. In any case where this is done, the onus is on the person driving the vehicle to prove that he has had no reasonable opportunity of registering the vehicle, and that it is being driven on the road for the purpose of being registered, namely direct to the appropriate registration office. The Police are entitled to make strict enquiries to satisfy themselves on these points and if satisfactory proof is not forthcoming to take proceedings under the Road Act or the Regulations as the case may be:- Or, The Regulations as the case may be, if an excise offence has been committed, to report the case to the Registration Authority with a view to prosecution. Having regard to the foregoing the Chief Constable directs that Superintendents will cause all manufacturers or dealers in the County jurisdiction to be warned as to the provisions of the law in this matter. O. 105/ 1918 The Chief Constable forwards herewith a supply of copies of an Army Order No. A6 225/1921 which contains the revised rates payable to the Keeper of a Victualling House which are specified in the Schedule to the Army and Air Force ( Annual) Act 1921 and he directs that a copy of same will be kept at Divisional and Sectional Station for reference if required. Copies of a new Army Form B55 (Demand for Billets) setting out the new rates and embodying also certain modifications made by the Act in the quantities of food and drink to be supplied by the keeper of a victualling house will be forwarded to Division as soon as received from the War Office. All the forms B55 will be destroyed as soon as the new Forms are received. General Order No. 213 14th August 1921 Journey of Her Majesty The Queen from from London to Scotland on 19th August 1921 On Friday 19th August 1921 Her Majesty the Queen will leave Euston Railway Station, by Special London and North Western Train by Special Western train at 5. 50p.m. and pass through Cheshire at the boundary between Cheshire and Staffordshire at the South side of Crewe Railway Station at about 8. 30p.m travelling, via Crewe (train stops for a few minutes at 8.56p.m) Hartford, Acton Bridge Preston Brook etc.) The Chief Constable directs that the usual precautions as to watching bridges etc. will be taken and the Constables will be at their posts at 8. 15pm on 19th August 1921 and remain until the train has passed. In the event of Superintendents considering it necessary to alter the Duty Scales in consequence of any local occurrence they will do so and report cause to the Chief Constable. General Order No. 215 18th August 1921 Journey of His Royal Majesty The Prince of Wales from London to Scotland on 22nd August 1921 On Monday 22nd August 1921 His Royal Highness the Prince of Wales will leave Euston Railway Station, by Special London and North Western Train by Special Western train at 7.45p.m.and pass through Cheshire at the boundary between Cheshire and Staffordshire at the South side of Crewe Railway Station at about 10. 45p.m. travelling, via Crewe (train stops for a few minutes at 11. 30p.m.) Hartford, Acton Bridge Preston Brook etc) The Chief Constable directs that the usual precautions as to watching bridges etc. will be taken and the Constables will be at their posts at 10. 30pm on 22nd August 1921 and remain until the train has passed. The portion of the line, the railway arches, bridges etc. to be travelled over will receive careful attention at irregular intervals during the previous 24 hours. Superintendents of above Divisions concerned to acknowledge receipt of this Order: General Order No. 216 18th August 1921 Motor Taxation Licenses and Licenses to Drive The Chief Constable has been informed that breaches of the law frequently take place in different parts of the County, under the following heads namely:- 1. By persons in possession of Motor Car Driving Licences, lending their Licenses to others who have failed to obtain driving licenses:- 2. Motor Cars registered at trade vehicles, being illegally used to carry passengers. 3. The use of "manufacturers" or "dealers", number plates on unregistered cars. Superintendents will let the above have their attention and see that the necessary instructions are given, so as to ensure the Police throughout the County being vigilant in the matter. Any offences detected will be reported in the usual way. General Order No. 217 20th August 1921 Licensing Act 1921 The Chief Constable forwards herewith:- 1. A copy of the latest form of the "Bill" as it passed both Houses of Parliament and which comes into operation on 1st September 1921. 2. A copy of Home Office Circular dated 18th August 1921 No. 418//299/ addressed to the Chief Constable. 3. Copy of Home Office Circular dated 18th August 1921 No. 418.299 addressed to the Clerk of the Justices. 4. Copy of Licensing Rules 1921 made under the above Act. And he directs that the new provisions will be carefully perused by Superintendents and explained to all ranks. Whenever it comes to the knowledge of Superintendents that licensing Justices consider the desirability of making an Order as to the "permitted hours" the same will be immediately reported to the Chief Constable, together with the views of the Superintendent, so that consideration may be given to the matter, and instructions sent to the Superintendent before the date of the Licensing Justices. Superintendents will also submit to the Chief Constable any notice received by them from licensees with regard to an extension of the permitted hours under Section 3 of the Act, together with a report on the matter. General Order No. 219 25th August 1921 Termination of The War Lights on Vehicles The Chief Constable has been informed by the Home Office that on the 10th August 1921, an Order in Council was made under the Termination of the present War (Definition) Act 1918, which provides that the War shall be deemed to terminate at midnight on 31st August 1921. Accordingly, as from that date, all Acts and Regulations, such as the Defence of the Realm Regulations, the operation which is limited to the duration of the War, will no longer have effect, and any orders made thereunder will cease to be operative. There are however, certain Acts such as the Special Constables Act 1914, the operation of which is continued for a period after the termination of the War, either by a provision in the Act itself or, by the War Emergency Laws (Continuance) Act 1920 and any such Acts will remain in force after the 31st instant, for the period prescribed in each case, unless repealed or revoked in the meantime. Consequent upon the above, the Lights (Vehicles) Order of 3rder of 30th September 1919 contained in S. G. O. 367/1919 will cease to have effect, after 31st August 1821. After that date, therefore, the lights to be carried on vehicles will be shown in the attached table.
