"No. 94 Stockton Heath" General Order No. 10 13th January 1894 New Clothing & Caps Immediately on receipt of above, Superintendents will forward to this Office the Contractor's Invoices and a report stating whether the articles mentioned therein have been received. The supply to be kept in some place well aired, where it cannot get damaged awaiting orders for fitting on from Head Quarters Articles received for Constables who have transferred since the Force was measured, will at once be sent to the Divisions, in which such Constables are now serving and those for Constables who have left the Force to Head Quarters. Superintendents will report when the above has been carried out. General Order No. 11 16th January 1894 Previous Convictions As soon as the previous convictions against persons committed for trial at Assizes or Quarter Sessions have been obtained, a list of same on Form D/5/a will be forwarded to the Chief Constable at the same time as the information is sent to the Governor of the Prison, directed in "Note" at foot of the Form, and if the prisoners have been photographed a copy of such will be attached to the List of Convictions sent to Head Quarters. The Chief Constable call on the Constable calls on the Constabulary not to relax in any way all the precautions to be taken to preventing this class of robbery, which have been committed in Cheshire either during February or March and, furthermore thinks it would be well to again, without raising any alarm, warn householders of residences where the above are likely to be committed to continue the precautions recommended in the Chief Constables Circular notes as there is reason to believe that this class of thief is about the County. A copy of this Return will be forwarded to this Office, on kept at Divisional Headquarters and one sent to the Contractors: Superintendents will be particular in seeing that the waist seam of the Tunics is flush with the bottom of the belt and that the skirts fit easy on the hips and that they do not open in front or behind. Clothing which require considerable alteration will be returned to the Contractor. Clothing which require only small alterations will be executed to the local tailors, and the names of such whom Superintendents can recommend to the Chief Constable who can do the work will be submitted to the Chief Constable for his consideration. Superintendents will be held responsible that all misfits are pointed out to the Contractors representatives and that the necessary particulars are full entered on the Return above mentioned. After the garment requiring alteration have been received back by Superintendent's a report will be sent to Head Quarters, when the Chief Constable will inspect the whole of the clothing. Browne No. 7 Hyde Division General Order No. 45 24th February 1894 Robberies The Chief Constable draws the attention of the Force to Route No. 1 dated at Nantwich 31st January 1894 and directs that Superintendents will cause all ranks to be on the alert to prevent this class of robbery, as a similar robbery took place at an Hotel at Stafford on the 22nd Instant and was no doubt, effected by the same person who committed the robberies at Crewe, and it is quite likely this thief may visit some part of Cheshire. The Chief Constable takes the opportunity of notifying to the Force that at this time of the year, owing probably to the "Waterloo Cup Grand Nation" and other popular race meetings many expert thieves are drawn to the neighbouring large town from which they are likely to make raids into Cheshire, it therefore behoves all ranks to be alert to prevent every kind of robberies. This should be done by some Sergeant or Constable appointed for the purpose. A special patrol of two Constables in plain clothes to be maintained during each evening between 6p.m.and 12a.m. around houses in suburban districts where ladder robberies are likely to be committed, this must be in addition to the ordinary patrol and if necessary to effect this, beats can be extended during the hours between 9a.m. and 1p.m. to enable the two Constables to carry out "special Patrol". The two special patrol Constables in plain clothes in the evening should make enquiries at all boat landing stages, Railway Stations and other places when going on duty and also when going off duty, to see if any suspicious strangers have been seen about and if so, warn the Officer in charge of District. The two Constables appointed for this special patrol should be those Sergeants or Constables who are now acting as plain clothes Constables in Divisions augmented by such other intelligent Constables that Superintendents may select. The object the Chief Constable has in view is that special enquiries should be made by the Sergeant or Constable acting as plain clothes Constabulary Divisions in which there are suburban districts and that he with another Constable specially selected by the Superintendent should patrol during the evenings as before stated. As there are more important races coming off during the next fortnight in Manchester & Liverpool many large houses in Cheshire will probably have "company" and such houses throughout the County special attention should be paid in rural districts. Great importance is attached to the information recovered from Liverpool Police as conveyed in "Memo to Superintendents" dated 17th Inst. Constables will be drawn more on the main roads leading to towards Chester and will work according to a special fixed scale to be made by Superintendents. Superintendents will not withdraw men stationed within the vicinity of Chester, or on the main road thoroughfares leading thereto for duty at the Races. Two Constable's from Wirral Division and two Constables from Hyde Divisions, the same as last year if without inconvenience to the public service will parade at the Chief Constables Office at 4.30p.m on the 30th Instant and be stationed at Head Quarters for duty to protect property in the out skirts of the city Superintendents of Broxton and Wirral Divisions will make out the necessary Special Duty Scales for these extra Constables and, Constables of beats in the vicinity of Chester, and forward a copy of each to this office. Ruxton £ 1. 6. 3 General Order No. 218 3rd August 1894 Ladder Robberies The attention of the Constabulary is specially drawn to the Ladder Robbery at the house of Princess Alexis Poltykoff Plough reported in the Newspapers 3rd August 1894. It will be observed that this class of thieves are becoming more daring in their procedures and are now doing their work almost before dark sets in, taking advantage of the windows of bedrooms being left open, no doubt in consequence of the summer weather. The Chief Constable call upon all ranks not to relax their energies to prevent this class of Robbery. Steady and constant vigilance must be perused, otherwise in some unprepared moment, these thieves who are quick to discover a careless Police force will make their raid when and where least expected. General Order No. 219 4th August 1894 Licensing Question Permitting Drunkeness The attention of the Force is drawn to the appeal case of Somerset Apple -lank V. Wade respondent, decided in the Court of Queen's Bench on the 16th February 1894 ( a full report will be found at page 231 of the Duties of the Peace14t April 1894) by which it will be observed that the High Court upheld the decision of certain Justices who dismissed a Summons against a Licensee for permitting drunkenness on his premises, on the grounds that the said Licensee did not know that such drunken person was drunk. As no doubt this decision will be made a strong point in the defence of licensee charged with a similar offence (permitting drunkenness) Constables at the time of visiting Licensed Houses should carefully observe what opportunity the Publican appears to have had of making himself aware of the drunken person's presence and condition and with this in view they will be particular in accurately noting the surround circumstances, such as, the number of persons in the House, whether the Licensee is very busy, and if possible they will endeavour by some means to ascertain how long the drunken person has been on the premises, where he had been previously and his condition as to sobriety on entering the house in which he was found drunk. Cattle found straying should be put back into the fields or the farmer informed that his gates were left open and the cattle are out. After the Constable has approved of the amount to be paid to the female attendant accompanying any girl to a Reformatory or Industrial School, the document bearing such approval will be receipted by the female concerned and attached to the pink Form (but not entered thereon) and the sum charged in Contingent Account as "Conveyance" but on a separate line and immediately underneath the case to which referred. If a Police Constable finds any horse, mule or ass so severely injured that it cannot without Cruelty be led away, he shall if the owner is absent or refuses to consent to the to the destruction of the animal at once summon a duly registered Veterinary Surgeon if any such Surgeon resides within a reasonable distance, and if it appears by the Certificate of which Veterinary Surgeon and if it appears by the Constable as such Veterinary Surgeon that the animal is so mortally injured or so severely wounded that it is cruel to keep it alive, it shall be lawful for the Police Constable without the consent of the Owner to slaughter the animal or cause it to be slaughtered with such instruments or appliances, and with such precautions and in such manner as to inflict as little pain and suffering as practicable. 3. Any reasonable expense may be incurred by the Constable in so slaughtering any such Animal or causing such Animal to be slaughtered, or in removing the carcase of such Animal from any Street or public place for the purpose of this Act, may be recovered from the Owner summarily as a Civil debt, subject as aforesaid, any expense incurred in the exaction of this Act shall be defrayed out of the out of the fund from which expenses of the Police are payable in the area in which the Animal is found. The Chief Constable further directs that arrangements will be made at suitable places, for all members of the Force who have not passed the second and third Examinations to again attend Lectures for the purpose of qualifying themselves for further examination, as it can be of no advantage to the public, for whose benefit, and at whose cost, Constables are instructed in this matter, if they do not keep up and maintain their knowledge of rendering "First Aid" and obtain second and third Certificates of efficiency. It must be borne in mind that one year has to elapse between each examination, and that members of the Force qualifying between each Examination and the members for first second or third examinations may attend the same course of Lectures or Class. Superintendents will therefore get in touch with Local Secretaries. Doctors and others interested in Ambulance Work, with the view of classes being formed and report to the Chief Constable on the 21st November 1894 the places where Lectures will be given and the names of proposed members, showing for which examination each individual is qualifying and probable cost. The Chief Constable desires it to be understood that Constables are liable to forfeit their Ambulance Badge, until they pass the third Examination. General Order No. 309 13th November 1894 Town's Police Clauses Act In order to make it quite clear that the Police can lay information and take proceedings under Section 28 of the above Act, the following copy of a letter dated 19th May 1893 from the Right Honourable the Secretary of State, Home Department is forwarded for the information of Superintendents. Letter see below: No. 48450/2 Home Office Whitehall 19th May 1893 Sir I have laid before the Secretary of State your letter of the 4th Instant, asking that the Standing Joint Committee of the County of Chester may be furnished with the opinion upon the Powers of the Police to enforce in Urban Sanitary Districts of the Sections of the Towns Police Clauses Act 1847 which are by Section 171 of the Public Health Act 1875, Incorporated in that Act. In reply I am to say, for the information of the Committee that as regards the provisions of the Towns Police Clauses Act other than those in Section 28, The Secretary of State is advised that, in our view of Section 253 of the Public Health Act, only an Officer of the Urban Sanitary Authority can prosecute. The case is different as regards Section 28 where it is provided (including the Amendment in Section 171 of the Public Health Act) that any Constable or Officer of Police acting in or for the District of any Urban Sanitary Authority shall take into custody without warrant, and forthwith warrant and forthwith convey before a Justice, any person who within his view commits such offence. As the conveyance before a Justice implies a general authority to inform, it appears to the Secretary of State that there must be an exception to Section 253 of the Public Health Act, so as to enable the Police to prosecute for Offences under Section 28. The decision in the case of Kyle & Barber, to which you refer in your letter, was a decision under a Local Act where there was no such provision as that quoted above, and it is clear that that case does not decide that the Police cannot prosecute for offences under Section 28 of the Towns Police Clauses Act 1847. Leigh Pemberton The Chief Constable considers it to be the duty of the Police, when on patrol, to observe any breach of other Sections of the Towns Police Clauses Act, and also Offences against the Local Bye Laws of the district in which they are stationed, and report same in the usual way, in order that the Superintendent of the Division, shall if necessary inform the Clerk to the Local Authority, and should the Local Authority take proceedings in such reported cases, the Constables having made the report will be available to prove same. If any objection to the Police laying information under Section 28 is experience, or any cases dismissed in consequence thereof, Superintendents will report particulars to the Chief Constable in accordance with "Memo" to Superintendents dated 8th February 1894. General Order No. 310 14th November 1894 Impounding Cattle The Chief Constable having observed that in some Divisions the practice exists to charge farmers and other residents whose cattle are found straying upon highways, a fee of 2/- Per head for impoundage, directs that such will at once be discontinued, proceedings should, if the Superintendent considers it necessary to be taken for allowing Animals to stray. The fee of 2/- may however continue to be charged to Gipsies and other persons who have no settled place and upon whom it would probably be very difficult to serve summonses. Superintendent Leah, Chief Clerk will attend at Runcorn on the above mentioned date for the purpose of examining the Divisional Books etc. General Order No. 335 3rd December 1894 Local Government Act 1894 Election of Councillors Police Disabilities Removals By Section 2 of the Police Disabilities Removals Act 1893 it is ordered that the promotion of the provision of Section 2 of the Police Disabilities Removals Act 1887 shall apply to all Municipal and other Elections as Parliamentary Elections subject to the modification that the words "Register of voters" shall mean the register of voters in force for such municipal or other Elections, any Constable therefore who is unable to vote at the Polling Booth or Station of the Polling District in which he resides, by being sent, or employed in the discharge of his duty may at any time within seven days before the Election for his district, apply to the Chief Constable for a Certificate to enable him to record his vote, at the place to which he may be sent on duty. In such applications which will be sent through Superintendents the Constable must state his registration number and description on the register of voters and also state the place at which he has been detailed to perform duty, so that the Chief Constable may give a proper Certificate as laid down in the Act. The Chief Constable will issue General Orders as to detail for duty in the various Polling places as soon as he receives certain necessary information from the Returning Officers of the several Division etc. upon receipt of such General Orders, Superintendents will immediately "tell off" of their respective Divisions and in any case where it is found absolutely necessary for Constables to be detailed for duty so that they are unable to vote at the Polling Station in their own Polling District, such Constables should be at once warned in order to give them sufficient time to make the application above referred to and receive the necessary Certificate from the Chief Constable to enable them to vote as above intimated. Superintendents in telling off their Constables must be as careful as possible not to send Constables outside their Polling District unless it is absolutely necessary for Police purposes, on the day of Election. General Order No. 346 7th December 1894 Prevention of Cruelty to Children The attention of the Force is drawn to G. O. 246/93 & 246/93. Although the Chief Constable still thinks that it is desirable that members of the Force should at all times act in harmony with the Society's Officers, he wishes all ranks to understand that it is the duty of the Police whenever there is cruelty suspected etc, to make prompt enquiries etc. if it is ascertained that an offence against the Act of Parliament has been committed and there is evidence to support it, it is also the duty of the Police to institute proceeding, and in support of this view he publishes for the information and guidance of the Constabulary, the following remarks upon the subject, made by Mr. Justice Grantham when addressing the Grand Jury at the recent Autumn Assizes at Hampshire. "that in every County he had visited on this circuit there were a great many cases under the Criminal Law Amendment Act and he found that they were in not in the hands of the Police the hands of as they ought to be, for the Police were the guardians of the safety of the public, but were generally in the hands of a private Society. It was the duty of the Police to prosecute and manage these things, it always used to be, and there had been no alteration in the law except that it had been mad stronger. The Society for the Prevention of Cruelty to Children did a great deal of good in its way but there had been no alteration in the law in regard to these cases and it was wrong to interfere and take them out of the hands of the Police. In one County a case occurred in which both County and City Police declined to take the case up, but referred the man to be the representative of the Society. He could not be found for three days the result was that when the case was enquired into, the Doctor's evidence was not of the slightest value. The Police got into a way of not doing their duty, by not going into the cases at all. They may possibly have been asked to leave them to the Society who chose which they cared to take on. It was a very improper state of things, it was the duty of the Police to take charge of all these cases and they might well understand that gross injustices might arise if they neglected to do so. They all appreciated the value of the Society in cases of child neglect: but it was not desirable and there wasn't necessity for them to interfere with the Police and lessen their responsibility. The reason alleged was that it saved the County expense but it was nothing of the kind, as the same expenses was allowed by the County in either case. He mentioned the matte because the Grand Jury were the representative for the Magistrates of the County and they must see that these cases were not taken out of the hands of the Police.
