Turner from Altrincham to Sale. Sergeant S. G. Cooper from Sale to Altrincham. Sergeant P. Turner and PC E. Burr will take up their quarters at the above station from the 13th instant, paying the usual rent of 10/10d and 8/8d per month respectively. Chief Constables Office, Chester 8th January 1883 Adulteration of Food and Drugs Act 1875 Constables Obtaining Samples for Analysis A case having been recently dismissed in the County in consequence of the Solicitor for the Defendant contending that Constables could not demand samples for analysis because they were not appointed by the Local Authority under the 13th Section of the above act. An extract from the annual report of the Local government Board for 1881-2 is given below for the information and guidance of Superintendents, who will always have a copy of same ready to produce for the inspection of the Magistrates when cases are to disposed of against persons for offences under the act, which clearly shows that a Constable may be employed to obtain samples and that subsequent proceedings can be taken by the Inspector although not the actual purchase. Extract from the Eleventh Annual Report of the Local Government Board 1881-82 "Two important decisions in the High Court of Justices have been given during the year with reference to the Sale of Food and Drugs Acts, In the case of Stare v Smith (45 JP141) it was held that where an article is purchased by an assistant acting on behalf of an Inspector appointed under Section 13 of the Act of 1875, it is not necessary that subsequent legal proceedings on account of adulteration should be taken by such assistant but that the Inspector is to be regarded as the actual purchaser, and as such, entitled to institute the proceedings. Constables, Sitting Down and Lounging in Court The Chief Constable having observed that Constables in some cases are in the habit when in Court at Petty Sessions of sitting down and lounging about when waiting for their cases to come on, or otherwise, desires that the practice may be discontinued, they can however on receiving permission of the Senior Officer present, if they are feeling tired of standing, retire from the Court for a short time to rest. The Chief Constable has great pleasure in noticing that the conduct of the men during the present period of the year has been so satisfactory, only four having been reported for Misconduct, which contrasts most favourably with former years, and he trusts that they will continue by strict attention to duty and the avoidance of all impropriety to maintain the good character of the Force. Vagrants The Chief Constable desires that Superintendents will give instructions to their men, especially to those stationed near Towns, to keep a sharp lookout for Tramps at night, as he is of the opinion that they will, now the "Casual Poor Act 1882" is in operation, sleep in out buildings and other places, instead of applying at the Union House for lodgings as heretofore, Constables in Rural Districts and all members of the Force, will also use their best endeavours to put down begging. Chief Constables Office, Chester 3rd February 1883 PC Reilly, Wirral Division, is fined 10/- and reduced to 26/10d, for being absent from his District without leave on the night of the 31st ultimo to 6am the 1st instant. Income Tax (Property) Schedule A. It having been decided in the Queen's Bench Division in the case of Coomber v The Justices of Berkshire (March 20, 21, 24 of 1882 Law Journal Reports) that the above Tax is not payable in respect of a building consisting partly of a Police Station, Superintendents will not in future pay same, and will at once apply to the Surveyor of Taxes, to refund any sums so paid since the above date, and credit the amount in the 17th Clause to the credit of the Police Rate. Fell, Nantwich Division is reduced to 23/11d per week, from the 3rd instant for marrying on the 31st ultimo, without first obtaining the sanction of the Chief Constable. Chief Constables Office, Chester 19th February 1883 Use of Magistrates Court Rooms by Tax Commissioners The Police Committee having passed the following Resolution at their meeting on the 14th instant in reference to the above, Superintendents will see that the same is carried out in respect to the use of the County Police Stations, the 7/6d to be charged for each meeting will be disposed of as follows, 5/- to the officer in charge of the building for cleaning, fuel and light, 2/6d being credited in the 17th Clause Return to the Police Rate. Extract from Proceedings of Police Committee 14th February 1883 "That the application of the Commissioners of Taxes to hold their meetings in the County Court Room at Hyde be acceded to on payment of 7/6d on each occasion, on the understanding that the County Magistrates have always prior right to use the same and not interfered with at any time by the meetings of the Commissioners, and that if similar applications be made at other places Colonel Hamersley be instructed to make similar arrangements with other Commissioners. All applications for the use of the court Houses under the above must be submitted to Chief Constable for sanction. Chief Constables Office, Chester 22nd February 1883 Allowance in Aid of Rent- Lodgers As the Chief Constable grants to Constables an allowance where Rents are excessive with a view of assisting them in payment of same, he desires it should be known that he deprecates their supplementing such allowances by taking in Lodgers, and directs that Superintendents will be careful in seeing that only Cottages or Houses with sufficient accommodation for the Constable and his family are taken by them wherever practicable. Lodgings for Constables Superintendents will give instructions that whenever a single Constable joins their Division, that a Sergeant assists him in obtaining suitable and comfortable lodgings, and that the people who keep the house are respectable, the Superintendent himself personally seeing that the lodgings are in every way fitted for a Constable to reside in. Chief Constables Office, Chester 24th February 1883 Army Reserve Men Men of the above Force appointed as Constables in the Cheshire Constabulary will be allowed, by order of the Police Committee, on the recommendation of the Chief Constable, to have their names retained on the strength of the Police Force as Supernumeraries without pay, during any period they are called out for service in the Army, and on the termination of their Military engagement be permitted to rejoin the Police Force without forfeiting their previous period of service. Chief Constables Office, Chester 2nd March 1883 The following transfers will take place on the 16th instant, Inspector P. Roche from Macclesfield to Runcorn Division to be stationed at Runcorn and Inspector J. Hollingworth from Runcorn to Macclesfield Division to be stationed at Wilmslow. Chief Constables Office, Chester 5th March 1883 Mid Cheshire Election-March 1883, Nomination Day at Knutsford at 11am 8th March 1883 Thursday 8th instant being the nomination day at Knutsford, Superintendent Leighton will attend at 10.30am with a Sergeant and six of his men of his Division who will return at once to their homes after their nomination. In the event of a contest taking place the following instructions will be most carefully observed and strictly carried out. 1. Superintendents will see before the day of the Election that all heaps of stones and other things easily used as missiles are quietly removed from the vicinity of the Polling Booths and other places where crowds are likely to assemble 2. Superintendents will make special arrangements to concentrate their men as directed in Memorandum of the 14th August last. 3. Lamps ready trimmed for use will be taken in the proportion of four to every ten men. Armlets will be worn by men on duty at places where disturbances are likely to occur. Cutlasses will be taken but carefully kept out of sight and on no account used except by the direct order of the Chief Constable. Old Clothing and Helmets will be worn. Metropolitan Staves will be taken. 4. A copy of the instructions for Constables on duty at Polling Booths will be in possession of each man (card dated 18th March 1880) and be returned through the Superintendent after the Election, they will receive their orders from the Presiding Officer. 5. Arrangements will be made with the Post Office Authorities at all places where the Polling will take place to send messages without loss of time in case of Riot. 6. If Revolvers are ordered to be taken they will not be used by order of the Chief Constable, in defence after firing by Armed Mobs. 7. Lists of men detailed for duty by Superintendents at Polling Booths and other places will be sent to the Chief Constable before the day of Election. 8. The Senior Officer in charge at the Polling places will keep the Chief Constable well informed by frequent telegrams of the state of the Districts, and as soon as the proceedings are over telegraph result, and whether all passed quietly. 9. Superintendents will dismiss their men to their several Districts as soon as possible, id appearances satisfy them that their services can safely be dispensed with, but not earlier than two hours after the termination of the Poll. 10. Superintendents and other officers in charge will strongly impress upon all their men that the utmost forbearance and good temper must be shown by them, as during the excitement of an election, angry words and rough usage may be expected, should however a breach of the peace be committed, or property destroyed, they must act with the greatest promptness and decision in order to prevent such a dangerous example spreading, and in the event of persons being taken into custody no unnecessary violence will be used in taking them to the Lock-Ups. 11. In the event of a Riot taking place the Senior Officer in charge will be ready to hand the Crowd with a copy of the Riot Act printed thereon dated March 1880 to a Magistrate, (arrangements being previously made from one to be present) 12. Officer in charge will recollect that if called upon to resist a Mob that the most effectual way is for the Constabulary to keep well together, otherwise they become weal and powerless. 13. Superintendents will see that proper arrangements are made for the men being supplied with proper meals, and lodgings, if required to be absent all night. 14. All Constables for duty Polling Booths must be present not later than 7.30am, to effect this, they must, if necessary, reach the different localities the night before. 15. The Chief Constable specially desires to impress upon all ranks of the Force, that they must abstain from expressing any political opinion likely to give offence, or do anything which might be construed as intended to influence in any way the Electors. 16. Superintendents will direct Constables to quietly inform all the householders in their Districts that the Police may be absent during the Polling Day and ask them not to leave their premises unprotected, as thieves and others may take advantage of the occasion. 17. A pen line will be run through the name of the late Chief Constable on the Cards "Instructions to officers on duty at Polling Booths" and "Riot Act" and the words "By Order of the Chief Constable of Cheshire" be inserted thereon instead. The Chief Constable hopes and has every confidence that the Constabulary will evince by their conduct and attention to perform the arduous and trying duties devolving upon them, that they have maintained the character of the Force for its reputation, discipline and efficiency. 18. In the event of any Superintendent being in doubt in carrying out these instructions, he will at once apply for information thereon. Future Orders will be issued giving detail of men for duty at the several Polling Booths. This order will be acknowledged by return of post. Chief Constables Office, Chester 5th March 1883 Attendance of Constables at Sales. As some misunderstanding appears to exist in reference to the duty of Constables attending large Sales by Auction in their District, Superintendents will give instructions, especially when large numbers of people assemble (at which thieves and other suspicious persons may be present to commit robberies and other offences) or other sufficient cause, for Constables to look round and preserve life and property. Constable will however perfectly understand that their attendance at such places is entirely a matter of public duty, and not in any way to act under those holding the Sale, or the owners of the property for Sale, unless they have been detailed for Special Duty application, they will also be cautioned not to partake of any drink at such places, which is generally supplied free of charge and with little limit, or to remain there longer than is necessary. Offences on Turnpike Roads and Highways Superintendents will see that greater attention is paid by Constables in preventing persons committing offences which cause obstruction, personal danger or interruption to persons travelling thereon. Chief Constables Office, Chester 6th March 1883 PC John McHale, Northwich Division is awarded by the Chief Constable, the extra Special duty Allowance of 5/- for courageous conduct in rescuing a man named Thomas Snelson from his bedroom, the house being on fire at the time, thereby saving his life. Chief Constables Office, Chester 10th March 1883 Mid Cheshire Election- March 1883 Wednesday 14th instant being the Polling day for the above Election, the following arrangements in addition to those directed in General Order 18/83 will be carried out 1. All the men not detailed for duty in the several Divisions will be in readiness to move on receipt of Telegram or other message. 2. The Chief Constable will be at Northwich with the Reserve and will be kept well informed during the day, by the Senior Officer in charge of the state of the several Districts, up to 6pm and later if necessary. 3. Staves will not be drawn except by direct order of the Senior Officer present, or when the Police have been assaulted, and are likely to be overpowered as such indiscretion might provoke a collision, all ranks will be most careful in exercising the utmost forbearance and good temper during the Election. 4. No person is allowed to enter by the Exit doors at Polling Booths, and it is only to be opened for the purpose of allowing voters to pass out after recording their votes, the entrance door will be kept open. 5. Superintendent Leighton will detail for duty at the Court House, Knutsford at 5.30pm on the 14thinstant, a Sergeant and one Constable, one to be stationed at the rear door of the Counting Room, and one at the outer door. 6. The High Sherriff and the Candidates are to be admitted to the room without producing any Card, no other person is to be allowed to enter the room unless he produces a Card authorising his admission, signed by Mr. John Tatlock, Acting under Sherriff. 7. Superintendents will place the Constables of the District on duty at the several Polling Booths, who will be relieved at certain periods of the day for rest and refreshment. 8. Advantage will be taken of this parade to have the monthly drill so as to avoid unnecessary expenses being incurred unless previously arranged. Chief Constables Office, Chester 28th March 1883 Constable Levi Bates, Eddisbury Division, is fined 10/- and reduced to 25/8d per week for improper conduct in calling upon a Magistrate at 10.30pm on the 20th instant, and being under the influence of drink at Tarporley on the same date. Constable Thomas Jones, Hyde Division, will be discharged from the Force on the 6th proximo for borrowing money from a Publican at Hoole when stationed at Headquarters. A copy of the "Explosive Substances Act 1883" will be forwarded for guidance and information, the attention of Inspectors appointed under the "Explosives Act 1875" is draw to the powers vested in them by Sections 73, 74 and 75 of the said Act, which they will carry out, especially Section 73, which gives power to search for ingredients of an explosive, as well as for the explosive itself, the same power being incorporated in the Act of 1883, and enabling them to search for and seize any apparatus for firing explosives. The Chief Constables desire that all members of the Constabulary will exercise the most special and vigilant observation in the performance of this important duty with a view to preventing acquisition by persons for unlawful objects, not only of explosives adapted for such purposes, but of the materials with which, they would be able, with a little technical knowledge to manufacture explosives. Vagrancy The chief Constable is glad to observe from the Return of Vagrants received during the year ending 31st ultimo, that there is a decrease throughout the county of 13,868 (the diminution appearing in all the Unions except Runcorn) and trusts that all members of the Force will continue to use their best efforts to suppress the mendicancy and professional begging. Adulteration Act 1875 The Chief Constable having observed that Superintendents have in some instances employed Constables to obtain Samples for analysis wishes it to be understood that the instructions in General Order 1/83, does not authorise them to do so, but only to employ their assistant for Weights and Measures for the purpose; except there is a special cause for acting otherwise, as Constables should not be taken from their beats or ordinary duty to purchase articles which necessitate their subsequent attendance at Court to give evidence in the case. Public and Beer Houses Several complaints having recently reached the Chief Constable in reference to disorderly conduct and illegal practices being carried on at the above places, especially in Rural Districts, on Saturdays and Sundays, directs that Superintendents will impress upon all their men that they are held responsible for the good order of such places and that they should frequently visit them with a view of checking such abuses, reporting any breach of the law. Fowl Stealing Several Robberies of Poultry having been recently reported, Superintendents will direct their men to use the greatest vigilance in preventing and detecting these offences, by working in plain clothes if necessary, and keeping a strict look out for all strangers and suspicious persons who may appear in their Districts. Clothing The Chief Constable having observed that Sergeants and Constables appear dressed in different articles of clothing directs that Superintendents will see that all lower ranks wear the clothing for the Season, as directed in Division Form D19 and dated 1st December 1881, unless otherwise specially directed by the Chief Constable. Adulteration of Food and Drugs Act 1875 Superintendents will obtain two or three samples of Beer for analysis during the present quarter taking same from Public or Beer Houses, in which they are most likely to find an adulterated article, not less than a third of a quart must be taken or sent to the Analyst. Beeston Castle Festival The Chief Constable has great pleasure in making known to the Constabulary that he has received from E. Davenport Esq., on behalf of the Beeston Festival Committee, a letter speaking most highly of the efficient manner in which the officers performed their duty, and the Chief Constable trusts they will at all such gatherings evince the same vigilance and obliging demeanour to the public, so as to deserve like commendation and praise. Conduct of Police Officers in Court The Chief Constable directs that Superintendents will impress upon their men that they are not to take part in the proceedings of any case before the Court by asking questions of Defendants or Witnesses or otherwise interrupting the business by making observations on the matter being heard, but that their duty consists in merely giving evidence and answering directly, without arguing, questions which may be put to them by the Defendants or others entitled to do so. The direction of all Polices Cases is in the hands of Superintendents or in his unavoidable absence, by the Police Officer in charge of the Court. Chief Constables Office, Chester 20th July 1883 Cheshire Assizes and Knutsford Adjourned Sessions All Prisoners in the Chester Castle and Knutsford Jails on the 23rd instant, awaiting trial, will whether committed for trial at the Assizes or Sessions, be tried by the Jude of Assize, commencing on that date, when all Constables and others must be present at Chester Castle at 11am on that day. A list of Prisoners committed between the 23rd July and the 5th of August next for trial at the adjourned Sessions at Knutsford on the 7th proximo, Superintendents stating therein whether there is any objection, and if so the reason, to any of the Prisoners being released on bail, if application is made to the Magistrates, until the Michaelmas Sessions in October next. Chief Constables Office, Chester 28th July 1883 Samples of Water for Analysis In future Superintendents will see, after having reported to the Chief Constable and received his instructions that samples of water from Police Stations are sent to the Analyst through the Sanitary Authorities of the District, otherwise a charge will be made by Dr. Bell to the sender for analysis. Unclaimed Property Superintendents will dispose of all unclaimed property in their Divisions to end of December 1882, and credit the amount realized in Clause 10 Return for August next, attaching a Statement of Form M/25 showing therein in Column "Remarks" the amount each article sold for. Superintendents not having any property to dispose of will enter a "memorandum" in red ink, in the 10th Clause to that effect, articles remaining unsold will be accounted for in the Quarterly Return to be furnished on the 29th of September next. Superintendents will also report on the matter to the Chief Constable. Constables on Special Service at Agricultural Shows and other Meetings As the Chief Constable has observed Constables loitering about when employed on Special Duty, it will be understood that whenever practicable, they should be told off in Sections with a Sergeant who will see that the men are always on the alert and performing their duty with attention. Chief Constables Office, Chester 17th October 1883 Reports of Robberies and other Offences The Chief Constable having noticed in the Newspapers, received information of the above through other sources than the Police, reminds Superintendents that it is their duty to make him thoroughly acquainted without delay, with the details of such matters which occur in their Divisions. Samples of Milk Inspectors of Weights and Measures when asked to do so by the Analyst will endeavour to obtain samples of milk direct from farms in order that they may be compared with the ordinary supply sold to the public from such farms. A Constable of this Force having stated at the hearing of a case in an adjoining Borough that he did not consider it his duty to take notice of offences occurring outside his District, the Chief Constable reminds the Cheshire Constabulary that although their duty is confined to the County, except when specially employed elsewhere, that he expects they will report any serious offences that may be brought to their notice when off duty, in other jurisdictions to the nearest Police Station, or officer, in order that he may deal with it as he may think fit. Chief Constables Office, Chester 22nd December 1883 Correspondence, Reports etc. Superintendents will see that all letters, sent to Head Quarters, are written and directed in the usual official manner, a third of a sheet being left as a margin, and that all documents enclosed therewith relating to same subject are placed in regular order according to date and fastened to the letter or report at the upper left hand corner, with a clip or fastener. Chief Constables Office, Chester 27th December 1883 PC J. Harrison to be Sergeant in Hyde Division at 30/4d per week exclusive of Merit Badge, from the 26th instant. PC P. Reilly, Wirral Division is reduced to 25/8d per week, deprived of 1 Good Conduct Badge, and transferred to Northwich Division, at his own expense, for being absent from his District without leave, and falsely stating to his Sergeant that he had obtained leave of absence. PC's A. Brand and W. Garner are both reduced to 23/11d per week and the latter fined 10/- for being in the "Railway Inn" Crewe at 12 midnight on the 17th instant (if transferred to another Division, it will at their own expense). Chief Constables Office, Chester 28th December 1883 The following transfers will take place on the 4th proximo, PC West from Backford to Eastham, PC Ridgway from Liscard to Backford and PC Morton from Nantwich to Wirral Division to be stationed at Liscard.
